  1.1                          A bill for an act 
  1.2             relating to local government; authorizing Wright 
  1.3             county to convey certain county ditches to the cities 
  1.4             of St. Michael and Albertville. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [WRIGHT COUNTY; CONVEYANCE OF CERTAIN COUNTY 
  1.7   DITCHES TO THE CITIES OF ST. MICHAEL AND ALBERTVILLE.] 
  1.8      The county of Wright may, by one or more resolutions of its 
  1.9   board of commissioners, convey to the cities of St. Michael and 
  1.10  Albertville all of its rights, title, and interests in all or 
  1.11  any portion of county ditches numbered 9 and 21. 
  1.12     Sec. 2.  [PROCEDURES AND CONDITIONS OF CONVEYANCE.] 
  1.13     The conveyance or conveyances will be effective as of the 
  1.14  date of such a county board resolution, if the cities of St. 
  1.15  Michael and Albertville, by resolution of their city councils: 
  1.16     (1) have agreed to accept the conveyance to the city of a 
  1.17  specific ditch or portion thereof; 
  1.18     (2) have agreed to assume as of the effective date, all of 
  1.19  the rights, title, and interests of the county; and 
  1.20     (3) have agreed to assume responsibility, under the city's 
  1.21  municipal authority, for management of surface water within the 
  1.22  area served by the ditch or portion of a ditch so conveyed. 
  1.23     Sec. 3.  [EFFECT OF CONVEYANCE.] 
  1.24     (a) Upon the effective date of a conveyance authorized 
  1.25  under this act, with respect to any ditch or portion of a ditch 
  2.1   so conveyed: 
  2.2      (1) the cities of St. Michael and Albertville shall hold 
  2.3   all of the county of Wright's property rights, title, and 
  2.4   interests in any ditch or portion of a ditch so conveyed; 
  2.5      (2) Wright county shall have no further responsibility for 
  2.6   the ditch or portion of a ditch so conveyed; and 
  2.7      (3) the cities of St. Michael and Albertville shall manage 
  2.8   surface water within the area served by the ditch or portion of 
  2.9   a ditch so conveyed pursuant to Minnesota Statutes, chapters 412 
  2.10  and 444, or other applicable law governing management of surface 
  2.11  water by cities. 
  2.12     (b) The county and the cities may enter into any agreement 
  2.13  or issue any document necessary to carry out the purposes of 
  2.14  this act. 
  2.15     Sec. 4.  [EFFECT ON REMAINING DITCHES.] 
  2.16     This act has no effect upon any ditch or portion of a ditch 
  2.17  that is not the subject of an agreement as described in section 
  2.18  2. 
  2.19     Sec. 5.  [EFFECTIVE DATE.] 
  2.20     Sections 1 to 4 are effective the day after the last of the 
  2.21  county board of Wright county, the city councils of St. Michael 
  2.22  and Albertville, and the chief clerical officer of each timely 
  2.23  completes compliance with Minnesota Statutes, section 645.021, 
  2.24  subdivisions 2 and 3.
