A bill for an act
relating to environment; requiring enhanced occupational safety standards for
closed landfill cleanup; requiring reports; proposing coding for new law in
Minnesota Statutes, chapter 115B.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Entities administering closed landfill program projects under sections 115B.39 to
115B.42 undertaken with funds from state bond proceeds must:

new text begin (1) conform to occupational safety and health standards under federal law and
chapter 182;
new text end

new text begin (2) as an additional occupational safety and health standard, develop a comprehensive
human health and safety plan for each project location and provide personal protective
equipment to all workers performing labor at each project location that protects against all
contaminants of concern and contaminants of potential concern identified at the project
location. For the purposes of this section, "contaminants of concern" and "contaminants
of potential concern" must be identified by methods substantially the same as the United
States Environmental Protection Agency's Superfund remedial investigation processes;

new text begin (3) before commencing work on a project undertaken with funds from state bond
proceeds, submit a report to the chairs of the committees of the house of representatives
and the senate having jurisdiction over labor and the environment on how they are
complying with the occupational safety and health standards required by this section; and

new text begin (4) provide on-site monitoring of compliance with the occupational safety and
health standards required by this section at all times that workers are performing labor at
a project location.
