  1.1                          A bill for an act 
  1.2             relating to the city of Detroit Lakes; authorizing the 
  1.3             city to impose sales and use taxes; specifying 
  1.4             purposes for expenditures of the proceeds of the taxes.
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [CITY OF DETROIT LAKES; TAXES.] 
  1.7      Subdivision 1.  [SALES AND USE TAXES AUTHORIZED.] 
  1.8   Notwithstanding Minnesota Statutes, section 477A.016, or any 
  1.9   other contrary provision of law, ordinance, or city charter, the 
  1.10  city of Detroit Lakes may, by ordinance, impose additional sales 
  1.11  and use taxes of up to one-half of one percent.  The provisions 
  1.12  of Minnesota Statutes, section 297A.48, govern the imposition, 
  1.13  administration, collection, and enforcement of the taxes 
  1.14  authorized under this subdivision. 
  1.15     Subd. 2.  [USE OF REVENUES.] Revenues received from the 
  1.16  taxes authorized under subdivision 1 must be used for 
  1.17  construction of a community center and for economic development 
  1.18  projects. 
  1.19     Subd. 3.  [REFERENDUM.] If the governing body of the city 
  1.20  of Detroit Lakes intends to impose the sales tax authorized by 
  1.21  this section, it shall conduct a referendum on the issue.  The 
  1.22  question of imposing the tax must be submitted to the voters at 
  1.23  a special or general election.  The tax may not be imposed 
  1.24  unless a majority of votes cast on the question of imposing the 
  1.25  tax are in the affirmative.  The commissioner of revenue shall 
  2.1   prepare a suggested form of question to be presented at the 
  2.2   election.  The referendum must be held at a special or general 
  2.3   election before December 1, 1998. 
  2.4      Sec. 2.  [EFFECTIVE DATE.] 
  2.5      This section is effective the day after compliance by the 
  2.6   governing body of the city of Detroit Lakes with Minnesota 
  2.7   Statutes, section 645.021, subdivision 3.
