1.1 A bill for an act 1.2 relating to motor vehicles; allowing certain half-ton 1.3 pickup trucks to be registered as farm trucks; making 1.4 clarifying changes; amending Minnesota Statutes 1998, 1.5 sections 168.011, subdivision 17; and 168.018. 1.6 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.7 Section 1. Minnesota Statutes 1998, section 168.011, 1.8 subdivision 17, is amended to read: 1.9 Subd. 17. [FARM TRUCK.] (a) "Farm truck" meansallany 1.10 single unittrucks, truck-tractors, tractors, semitrailers, and1.11trailerstruck, including a pickup truck with a manufacturer's 1.12 nominal rated carrying capacity of at least one-half ton, 1.13 truck-tractor, tractor, semitrailer, or trailer used bytheits 1.14 ownerthereofto transport agricultural, horticultural, dairy, 1.15 and other farm products, including livestock, produced or 1.16 finished by the ownerof the truck, and any other personal 1.17 property owned by the farmer to whom the license for the truck 1.18 is issued, from the farm to market, and to transport property 1.19 and supplies to the farm of the owner.Trucks, truck-tractors,1.20tractors, semitrailers, and trailers registered as "farm trucks1.21 (b) A truck, truck-tractor, tractor, semitrailer, or 1.22 trailer registered as a "farm truck" may be used: 1.23 (1) bytheits ownerthereofto occasionally transport 1.24 unprocessed and raw farm products, not produced by the owner of 1.25 the truck, from the place of production to market when the 2.1 transportation constitutes the first haul of the products, and2.2may be used; 2.3 (2) bytheits ownerthereof, who is either a farmer or 2.4 logger who harvests and hauls forest products only, to transport 2.5 logs, pulpwood, lumber, chips, railroad ties, and other raw and 2.6 unfinished forest products from the place of production to an 2.7 assembly yard or railhead when the transportation constitutes 2.8 the first haulthereofof the forest products, provided that the 2.9 owner and operator of the vehicle transporting planed 2.10 lumbershall havehas in immediate possession a statement signed 2.11 by the producer of the lumber designating the governmental 2.12 subdivision, section, and township where the lumber was produced 2.13 and that this haul, indicating the date, is the first haul 2.14thereof. The licensed vehicles may also be usedof the planed 2.15 lumber; and 2.16 (3) bytheits ownerthereof, if the vehicle is licensed, 2.17 to transport,to and fromtimber harvestingtimber-harvesting 2.18 areas, equipment and appurtenances incidental to timber 2.19 harvesting, and gravel and otherroad buildingroad-building 2.20 materials for timber haul roads. 2.21"Farm trucks" shall also include(c) Farm truck also 2.22 includes only single unit trucks, whichthat, because of their 2.23 construction, cannot be used for any other purpose and are used 2.24 exclusively to transport milk and cream en route from farm to an 2.25 assembly point or place for final manufacture, and for 2.26 transporting milk and cream from an assembly point to a place 2.27 for final processing or manufacture. Thissection shall2.28 paragraph does notbe construed tomean that the owner or 2.29 operator of the truck cannot carry on usual accommodation 2.30 services for patrons on regular return trips, such as butter, 2.31 cream, cheese, and other dairy supplies. 2.32 Sec. 2. Minnesota Statutes 1998, section 168.018, is 2.33 amended to read: 2.34 168.018 [QUARTERLY REGISTRATION OF FARM TRUCKS.] 2.35 (a) The owner of (1) any farm truck as defined in section 2.36 168.011, subdivision 17, including a pickup truck with a 3.1 manufacturer's nominal rated carrying capacity of at least 3.2 one-half ton, or (2) a truck owned by a retailer who is engaged 3.3 in the intrastate transportation of fertilizer or agricultural 3.4 chemicals directly to a farm for on-farm use within a radius of 3.5 50 miles of the retailer's business location, may elect to 3.6 register and license the truck only for one or more quarters of 3.7 a registration year, at a tax of one-fourth of the annual tax on 3.8 the vehicle plus $5 for each quarterly registration. 3.9 (b) The owner may not apply for quarterly registration or 3.10 renewal until seven days before the selected quarter or 3.11 concurrent quarters. The expiration date of a 3.12 registrationshallmust be displayed on the license platein3.13such a manneras directed by the registrarshall direct.No3.14 (c) A truck registered on a quarterly basisshallmust not 3.15 be operated on the public streets and highways more than ten 3.16 days beyond the end of the quarter for which it is registered, 3.17 unless the registration has been renewed for another quarter or 3.18 for the remainder of the registration year. 3.19 (d) For purposes of this section, registration quarters 3.20shallbegin on March 1, June 1, September 1, and December 1.
