  1.1                          A bill for an act
  1.2             relating to health; requiring the department of health 
  1.3             to adopt measures that minimize the exposure of 
  1.4             children to toxic chemicals; proposing coding for new 
  1.5             law in Minnesota Statutes, chapter 144. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [144.966] [MINIMIZING CHILDREN'S EXPOSURE TO 
  1.8   TOXIC CHEMICALS.] 
  1.9      (a) In developing new or revised rules, standards, or 
  1.10  policies that affect, directly or indirectly, the amount of 
  1.11  toxic substances released into the environment, the commissioner 
  1.12  of health shall adopt provisions that minimize or prevent 
  1.13  exposure of children to toxic substances that may pose a risk to 
  1.14  children for: 
  1.15     (1) adverse reproductive outcomes; 
  1.16     (2) respiratory disease; 
  1.17     (3) immunologic suppression; 
  1.18     (4) cancer; 
  1.19     (5) neurologic development; 
  1.20     (6) endocrinal (hormonal) functioning; 
  1.21     (7) general infant and child development; or 
  1.22     (8) any other important health outcomes identified by the 
  1.23  department of health. 
  1.24     (b) In adopting any such rules, standards, or policies, the 
  1.25  commissioner of health shall consider the physiological 
  2.1   differences between children and adults.  This section applies 
  2.2   to the extent not inconsistent with federal law and other 
  2.3   provisions of state law.
