  1.1                          A bill for an act
  1.2             relating to education; encouraging school districts to 
  1.3             accept academically at-risk students under open 
  1.4             enrollment; appropriating money; amending Minnesota 
  1.5             Statutes 1996, section 120.062, by adding a 
  1.6             subdivision; Minnesota Statutes 1997 Supplement, 
  1.7             section 120.062, subdivisions 3 and 11; proposing 
  1.8             coding for new law in Minnesota Statutes, chapter 124A.
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.11  120.062, subdivision 3, is amended to read: 
  1.12     Subd. 3.  [LIMITED ENROLLMENT OF NONRESIDENT PUPILS.] (a) A 
  1.13  school board may, by resolution, limit the enrollment of 
  1.14  nonresident pupils in its schools or programs according to this 
  1.15  section to a number not less than the lesser of: 
  1.16     (1) one percent of the total enrollment at each grade level 
  1.17  in the district; or 
  1.18     (2) the number of district residents at that grade level 
  1.19  enrolled in a nonresident district according to this section.  
  1.20     (b) A district that limits enrollment of nonresident pupils 
  1.21  under paragraph (a) shall report to the commissioner by July 15 
  1.22  on the number of nonresident pupils denied admission due to the 
  1.23  limitations on the enrollment of nonresident pupils. 
  1.24     (c) A school board that limits the enrollment of 
  1.25  nonresident students under paragraph (a) must give first 
  1.26  priority to enrolling all interested students who: 
  1.27     (1) reside in a school district in which at least 25 
  2.1   percent of the enrolled students are eligible to receive a free 
  2.2   or reduced price school meal; 
  2.3      (2) are eligible to receive a free or reduced price school 
  2.4   meal; and 
  2.5      (3) are at risk of not meeting the state's basic skills 
  2.6   requirements under section 121.11, subdivision 7, as determined 
  2.7   by the school principal or other person having administrative 
  2.8   control of the school. 
  2.9      Sec. 2.  Minnesota Statutes 1996, section 120.062, is 
  2.10  amended by adding a subdivision to read: 
  2.11     Subd. 9a.  [TRANSPORTATION; TRANSFER OF ACADEMICALLY 
  2.12  AT-RISK STUDENTS.] (a) Notwithstanding subdivision 9, if 
  2.13  requested by the parent of a student under subdivision 3, 
  2.14  paragraph (c), who is enrolling in a nonresident district under 
  2.15  this section the resident school district shall provide 
  2.16  transportation services from the student's residence to the 
  2.17  school actually attended. 
  2.18     (b) The state shall pay state aid to the resident school 
  2.19  district equal to the district's actual expenditures for 
  2.20  transportation services provided under this subdivision. 
  2.21     (c) The school district may, at the district's discretion: 
  2.22     (1) provide transportation services directly; 
  2.23     (2) contract with another school district or a private 
  2.24  carrier for the services; or 
  2.25     (3) reimburse the student's parent for the lesser of the 
  2.26  actual costs of transportation or 31 cents per mile. 
  2.27     Sec. 3.  Minnesota Statutes 1997 Supplement, section 
  2.28  120.062, subdivision 11, is amended to read: 
  2.29     Subd. 11.  [INFORMATION.] A district shall make information 
  2.30  about the district, schools, programs, policies, and procedures 
  2.31  available to all interested people., giving first priority to 
  2.32  providing timely, useful, and accessible information to the 
  2.33  families of students who meet the eligibility criteria under 
  2.34  subdivision 3, paragraph (c), and reside in a metropolitan 
  2.35  school district in which at least 25 percent of the enrolled 
  2.36  students are eligible to receive a free or reduced price school 
  3.1   meal.  A school district that enrolls a student under 
  3.2   subdivision 3, paragraph (c), shall provide ongoing counseling 
  3.3   and guidance services to that student during the entire time the 
  3.4   student is enrolled in the district.  
  3.5      Sec. 4.  [124A.038] [ADDITIONAL ENROLLMENT OPTIONS 
  3.6   PAYMENTS.] 
  3.7      Subdivision 1.  [COUNSELING SERVICES.] The state shall pay 
  3.8   state aid equal to the lesser of a district's actual 
  3.9   expenditures for counseling and guidance services provided to 
  3.10  students that enroll in a nonresident district under section 
  3.11  120.062, subdivision 3, paragraph (c), or $100 per pupil that 
  3.12  enrolls under section 120.062, subdivision 3, paragraph (c). 
  3.13     Subd. 2.  [TRANSPORTATION SERVICES.] The state shall pay 
  3.14  additional transportation aid to a resident school district 
  3.15  according to section 120.062, subdivision 9a. 
  3.16     Subd. 3.  [EFFICIENCY INCENTIVES.] A school district of 
  3.17  residence and a school district providing instruction to a pupil 
  3.18  that enrolls under section 120.062, subdivision 3, paragraph 
  3.19  (c), are eligible for efficiency incentives revenue if at least 
  3.20  ten pupils from a single attendance area choose to attend the 
  3.21  same nonresident school program.  Efficiency incentives revenue 
  3.22  is equal to $100 times the number of nonresident pupils enrolled 
  3.23  in the same nonresident school program.  Efficiency incentives 
  3.24  revenue must be used for expenditures related to pupils who 
  3.25  attend a nonresident school district under section 120.062, 
  3.26  subdivision 3, paragraph (c). 
  3.27     Sec. 5.  [APPROPRIATIONS.] 
  3.28     Subdivision 1.  [DEPARTMENT OF CHILDREN, FAMILIES, AND 
  3.29  LEARNING.] The sums indicated in this section are appropriated 
  3.30  from the general fund to the commissioner of children, families, 
  3.31  and learning in the fiscal years designated. 
  3.32     Subd. 2.  [COUNSELING.] For counseling and guidance 
  3.33  services under Minnesota Statutes, section 120.062, subdivision 
  3.34  11:
