A bill for an act
relating to public safety; permitting certain military personnel stationed outside
the state to obtain extensions of their permit to carry a handgun; amending
Minnesota Statutes 2014, section 624.714, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 624.714, is amended by adding a
subdivision to read:

new text begin (a) A permit holder who meets the
eligibility standards described in paragraph (b) may apply to the appropriate sheriff for
an extension of the holder's permit under this subdivision.

new text begin (b) A permit holder is eligible for an extension if the holder:

new text begin (1) is a member of the United States armed forces, including the National Guard of
any state and the United States Coast Guard;
new text end

new text begin (2) is on active service as defined under section 190.05;
new text end

new text begin (3) is stationed or deployed outside of Minnesota;
new text end

new text begin (4) is unlikely to be able to return to Minnesota before the permit expires due to the
holder's military commitment; and

new text begin (5) is not prohibited by law from possessing a firearm.

new text begin (c) A permit holder seeking an extension under this subdivision shall submit an
affidavit to the appropriate sheriff attesting to the holder's eligibility under paragraph (b).
In addition, the affidavit must specify the requested extension period, which must coincide
with the expected time period during which the holder is unlikely to be able to return to
Minnesota due to the holder's military commitment. The affidavit must be submitted no
earlier than 90 days before the permit's expiration date and no later than the expiration date.

new text begin (d) A permit holder is not required to request an extension under this subdivision in
person or to have received recent training in the safe use of a pistol.

new text begin (e) A sheriff shall grant an extension without charging a fee to a qualified permit
holder who complies with the requirements of this subdivision. Upon granting the
extension, the sheriff shall send a new permit card to the holder that reflects the extended
expiration date.

new text begin (f) A permit holder shall apply for a permit renewal at the first opportunity after
the holder has returned to Minnesota for a period that is reasonably sufficient to allow
an application for a renewal. A return for a 90-day or greater period is presumed to be
a sufficient period. The provisions of this section relating to permit renewals apply to
renewals under this paragraph.
