A bill for an act
relating to education; allowing school districts to access personnel files of
prospective teachers from their employing districts; amending Minnesota Statutes
2020, sections 122A.40, by adding a subdivision; 122A.41, by adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2020, section 122A.40, is amended by adding a subdivision
to read:

section 13.43, a district seeking to fill a teaching position that schedules an interview with
a prospective teacher currently employed by a Minnesota school district may request from
the teacher's district access to the teacher's personnel file for inspection. The teacher's
employing district must make the contents of the teacher's personnel file available to the
hiring district for inspection and must inform the teacher that access to the teacher's personnel
file has been requested. The hiring district cannot use the contents of the teacher's personnel
file to cancel a scheduled interview with the teacher.
