  1.1                          A bill for an act 
  1.2             relating to boilers; requiring the commissioner of 
  1.3             labor and industry to amend certain high pressure 
  1.4             boiler plant rules. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  [HIGH PRESSURE BOILER PLANT RULES.] 
  1.7      The commissioner of labor and industry shall adopt rules 
  1.8   amending Minnesota Rules, part 5225.1180, subparts 2 and 3, so 
  1.9   that only a high pressure boiler plant of more than 300 
  1.10  horsepower, when in operation, shall require constant attendance 
  1.11  as required under subpart 3.  The rule shall require high 
  1.12  pressure boiler plants of 31 to 300 horsepower to be treated the 
  1.13  same for purposes of part 5225.1180.  In adopting the rules, the 
  1.14  commissioner is exempt from the rulemaking provisions of 
  1.15  Minnesota Statutes, chapter 14, including section 14.386, but 
  1.16  shall use the provisions of section 14.386, paragraph (a), 
  1.17  clauses (1) and (3).  Minnesota Statutes, section 14.386, 
  1.18  paragraph (b), does not apply to these rules.
