  1.1                          A bill for an act 
  1.2             relating to environment; encouraging recycling of 
  1.3             construction debris by public entities; restricting 
  1.4             disposal of arsenic-treated lumber; proposing coding 
  1.5             for new law in Minnesota Statutes, chapter 115A. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [115A.461] [RECYCLING OF CONSTRUCTION DEBRIS BY 
  1.8   PUBLIC ENTITIES.] 
  1.9      Where an approved county plan designates recycling of 
  1.10  construction debris as the preferred waste management method for 
  1.11  construction debris produced by the county, each public entity 
  1.12  within the county also is encouraged to recycle construction 
  1.13  debris produced by the public entity.  For purposes of this 
  1.14  section, "public entity" has the meaning given it in section 
  1.15  115A.471. 
  1.16     Sec. 2.  [115A.975] [DISPOSAL OF ARSENIC-TREATED LUMBER.] 
  1.17     (a) Treated lumber infused with arsenic may not be used as 
  1.18  mulch or animal bedding. 
  1.19     (b) A waste hauler or a person operating a construction 
  1.20  debris recycling facility may not knowingly send or transport 
  1.21  treated lumber to a resource recovery facility or to an unlined 
  1.22  solid waste disposal facility, including, but not limited to, an 
  1.23  unlined construction or demolition debris land disposal facility.
