  1.1                          A bill for an act 
  1.2             relating to the environment; modifying the application 
  1.3             of recyclable material container requirements for 
  1.4             public entities; amending Minnesota Statutes 2000, 
  1.5             section 115A.151. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 115A.151, is 
  1.8   amended to read: 
  1.9      115A.151 [STATE AND LOCAL FACILITIES RECYCLABLE MATERIAL 
  1.10  CONTAINER REQUIREMENTS; PUBLIC ENTITIES.] 
  1.11     (a) A state agency, local unit of government, or school 
  1.12  district public entity shall: 
  1.13     (1) ensure that facilities under its control, from which 
  1.14  mixed municipal solid waste is collected, have containers for at 
  1.15  least three recyclable materials, such as, but not limited to, 
  1.16  paper, glass, plastic, and metal; and 
  1.17     (2) transfer all recyclable materials collected to a 
  1.18  recycler. 
  1.19     (b) For the purposes of this section: 
  1.20     (1) "public entity" means the state, an office, agency, or 
  1.21  institution of the state, the metropolitan council, a 
  1.22  metropolitan agency, the metropolitan mosquito control 
  1.23  commission, the legislature, the courts, a county, a statutory 
  1.24  or home rule charter city, a town, a school district, another 
  1.25  special taxing district, or any other entity that receives an 
  2.1   appropriation from the state for a capital improvement project 
  2.2   after the effective date of this section; 
  2.3      (2) "metropolitan agency" and "metropolitan council," have 
  2.4   the meanings given them in section 473.121; and 
  2.5      (3) "metropolitan mosquito control commission" means the 
  2.6   commission created in section 473.702.
