A bill for an act
relating to traffic regulations; prohibiting issuance of citations or fines to drivers
that park at broken, malfunctioning, or inoperable parking meters; amending
Minnesota Statutes 2014, sections 169.011, by adding a subdivision; 169.35, by
adding a subdivision.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 169.011, is amended by adding a
subdivision to read:

new text begin "Parking meter" means a device that registers the
amount of time purchased to park a motor vehicle in a specific parking space, at the
expiration of which the driver is liable for a fine.

Sec. 2.

Minnesota Statutes 2014, section 169.35, is amended by adding a subdivision
to read:

new text begin Metered parking; ticketing prohibition. new text end

new text begin (a) A municipality, county, road
authority, or any other public entity operating and enforcing parking meters is prohibited
from issuing a citation or imposing a fine to any driver who parks a motor vehicle in a
parking space with a broken, malfunctioning, or inoperable parking meter.

new text begin (b) Any citation or fine imposed on a driver who parks a motor vehicle in a parking
space with a broken, malfunctioning, or inoperable parking meter must be refunded to the
driver by the municipality, county, road authority, or other public entity that issued the
citation or imposed the fine in violation of this subdivision.
