A bill for an act
relating to greenhouse gas emissions; directing the Pollution Control Agency
to draft a proposed rule enabling Minnesota to participate in a regional
cap-and-trade system to reduce greenhouse gas emissions.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) If, by September 1, 2010, the federal government has not enacted a
comprehensive and enforceable law that requires substantial reductions in emissions of
greenhouse gases over time, as determined by the commissioner of the Pollution Control
Agency, the Pollution Control Agency must draft, but may not adopt, a proposed rule
under Minnesota Statutes, sections 14.131 to 14.15, that fully enables Minnesota to
participate in a regional cap-and-trade system with other midwestern states. The Pollution
Control Agency must use the most recent draft model rule published by the Midwestern
Greenhouse Gas Reduction Accord Advisory Group as the basis for its rule and must
submit a completed proposed rule to the chairs and ranking minority members of the
senate and house of representatives committees with primary jurisdiction over energy
policy and finance, environment policy and finance, and commerce by February 1, 2011.

(b) A proposed rule developed under this section must be consistent with Minnesota's
greenhouse gas emissions reductions goals established under Minnesota Statutes, section
216H.02, subdivision 1.
