A bill for an act
relating to health; requiring the delay of annual mass flu vaccination clinics in
the event of a flu vaccine shortage; imposing penalties; proposing coding for new
law in Minnesota Statutes, chapter 144.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Delayed vaccination. new text end

new text begin Annual mass flu vaccination clinics for
individuals who are not in a high-risk priority group according to the guidelines established
by the National Advisory Committee on Immunization Practices shall be delayed until
November 1 of each year, unless the commissioner of health has determined that there
will be a sufficient supply of the vaccine and has posted a notice of this determination
on the Department of Health's Web site.

new text begin The commissioner of health may impose a fine of up to $1,000
upon a person found in violation of this section. The commissioner may impose a fine of
up to $10,000 upon a person who intentionally or repeatedly violates this section.
