A bill for an act
relating to government operations; making permanent certain Help America Vote
Act rules adopted by the Office of the Secretary of State; providing that tribal
driver's licenses and identification cards are acceptable forms of identification;
proposing coding for new law in Minnesota Statutes, chapter 171.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

new text begin The rules adopted by the Office of the Secretary of State pursuant to the authority
granted in Laws 2004, chapter 293, article 1, section 39, are adopted as permanent rules
without further administrative action and may be further amended or repealed by the
secretary of state pursuant to Minnesota Statutes, chapter 14.

new text begin The revisor of statutes shall publish these rules in Minnesota Rules.

Sec. 2.

new text begin [171.017] TRIBAL DRIVER'S LICENSE AND IDENTIFICATION
CARD.
new text end

new text begin (a) Notwithstanding any law to the contrary, wherever in Minnesota Statutes
or Minnesota Rules a Minnesota driver's license or identification card is deemed an
acceptable form of identification, a tribal driver's license or identification card shall be an
equivalent form of identification.

new text begin (b) For purposes of this section, "tribal driver's license or identification card" means
an unexpired tribal driver's license or identification card issued by the tribal government
of a tribe with a reservation located in whole or in part in Minnesota and recognized
by the Bureau of Indian Affairs, United States Department of the Interior, that contains
the elements of information required in section 171.07, subdivision 1, clause (a), and
subdivision 3, clause (a), respectively, and meeting the standards set forth in section
171.01, subdivision 9, except that the provisions in section 171.01, subdivisions 1 and 3,
requiring the description of the applicant in the manner the commissioner deems necessary
shall be construed to mean as the tribal government deems necessary.
