A bill for an act
relating to public safety; requiring school officials to report violent offenses to
the local law enforcement agency; proposing coding for new law in Minnesota
Statutes, chapter 626.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin Definitions. new text end

new text begin (a) As used in this section, the following terms have
the meanings given them.

new text begin (b) "Crime of violence" has the meaning given in section 624.712, subdivision 5.

new text begin (c) "School official" means superintendents, principals, and professional employees
who devote 50 percent or more of their time to administrative or supervisory duties over
other personnel, and includes athletic coaches.

new text begin (d) "School property" means:

new text begin (1) a public or private elementary, middle, or secondary school building and its
improved grounds, whether leased or owned by the school;

new text begin (2) the area within a school bus when that bus is being used by a school to
transport one or more elementary, middle, or secondary school students to and from
school-related activities, including curricular, cocurricular, noncurricular, extracurricular,
and supplementary activities; and

new text begin (3) that portion of a building or facility under the temporary, exclusive control of a
public or private school, a school district, or an association of such entities.

new text begin A school official shall immediately
report to the local police department or county sheriff all substantiated allegations of a
crime of violence involving a student and occurring on school property.

new text begin Immunity from liability. new text end

new text begin Any person reporting in good faith and
exercising due care shall have immunity from any civil or criminal liability that otherwise
might result by reason of the person's actions pursuant to this section. No cause of action
may be brought against any person for not making a report pursuant to this section.
