  1.1                          A bill for an act 
  1.2             relating to utilities; requiring electric utilities to 
  1.3             disclose the sources of their electric supply, and the 
  1.4             amounts of certain pollutants attributable to the 
  1.5             generation of that electric supply; proposing coding 
  1.6             for new law in Minnesota Statutes, chapter 216B. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [216B.169] [PORTFOLIO INFORMATION DISCLOSURE.] 
  1.9      Subdivision 1.  [QUARTERLY REPORT.] An electric utility, as 
  1.10  defined in section 216B.38, subdivision 5, shall provide the 
  1.11  following information to its customers on a quarterly basis: 
  1.12     (1) the amount of electric energy produced or purchased for 
  1.13  resale by the utility in the previous 12 months of each of the 
  1.14  following sources of electricity, expressed as a percentage of 
  1.15  the total electric energy produced or purchased for resale by 
  1.16  the utility in that period:  biomass power, coal-fired power, 
  1.17  hydropower, natural gas-fired power, nuclear power, oil-fired 
  1.18  power, solar power, wind power, and system power; 
  1.19     (2) a pie chart that graphically depicts the percentages of 
  1.20  the sources of the electric energy produced or purchased for 
  1.21  resale by the utility in the previous 12 months, as identified 
  1.22  under clause (1); and 
  1.23     (3) a standardized chart, in a format to be determined by 
  1.24  the commission, that clearly depicts the amounts of carbon 
  1.25  dioxide emissions, nitrous oxide emissions, sulfur dioxide 
  1.26  emissions, and nuclear waste attributable to the generation of 
  2.1   the electric energy produced or purchased for resale by the 
  2.2   utility in the previous 12 months, as identified in clause (1). 
  2.3      Subd. 2.  [SYSTEM POWER.] (a) "System power" means 
  2.4   electricity purchased from the regional electric grid, the 
  2.5   source of which would be impossible or unreasonably expensive to 
  2.6   identify.  For the purposes of reporting emissions under 
  2.7   subdivision 1, clause (3), the pollution control agency shall 
  2.8   calculate the emissions attributable to system power, based on 
  2.9   the percentage of power produced in the Mid-Continent Area Power 
  2.10  Pool of each on the nonsystem power categories listed in 
  2.11  subdivision 1, clause (1), in the previous 12 months and shall 
  2.12  certify those percentages to the commission. 
  2.13     (b) An electric utility may only claim that system power 
  2.14  comprises more than ten percent of the utility's electric energy 
  2.15  portfolio if the utility petitions the commission and the 
  2.16  commission finds that the source of that portion of the 
  2.17  utility's portfolio claimed as system power would be impossible 
  2.18  or unreasonably expensive to identify. 
  2.19     Sec. 2.  [EFFECTIVE DATE.] 
  2.20     Section 1 is effective April 1, 1999.
