  1.1                          A bill for an act 
  1.2             relating to courts; prohibiting discrimination in 
  1.3             providing access to public accommodations because of 
  1.4             means of transportation or insignia on clothing; 
  1.5             providing a civil remedy; imposing a penalty; 
  1.6             proposing coding for new law in Minnesota Statutes, 
  1.7             chapter 604. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  [604.12] [DISCRIMINATION IN CERTAIN PUBLIC 
  1.10  ACCOMMODATIONS.] 
  1.11     Subdivision 1.  [DEFINITION.] For purposes of this section 
  1.12  "place of public accommodation" has the meaning given in section 
  1.13  363.01, subdivision 33. 
  1.14     Subd. 2.  [PROHIBITION; MISDEMEANOR.] It is unlawful for a 
  1.15  person to discriminate against an individual with respect to 
  1.16  access or admission to, or full utilization of, a place of 
  1.17  public accommodation because of the individual's mode of 
  1.18  transportation or the fact that the person has the name of an 
  1.19  organization or association on the person's clothing.  A person 
  1.20  who violates this subdivision is guilty of a misdemeanor. 
  1.21     Subd. 3.  [CIVIL REMEDY.] An individual injured by a 
  1.22  violation of subdivision 2 may bring an action to recover actual 
  1.23  damages, exemplary damages, injunctive relief, and reasonable 
  1.24  attorney fees for the violation. 
  1.25     Sec. 2.  [EFFECTIVE DATE; APPLICATION.] 
  1.26     Section 1, subdivision 2, is effective July 1, 1998, and 
  2.1   applies to offenses committed on or after that date.  Section 1, 
  2.2   subdivision 3, is effective July 1, 1998, and applies to causes 
  2.3   of action arising on or after that date.
