  1.1                          A bill for an act
  1.2             relating to commerce; prohibiting telephone 
  1.3             solicitations by the use of predictive dialing 
  1.4             devices; amending Minnesota Statutes 1996, section 
  1.5             325E.26, by adding subdivisions; proposing coding for 
  1.6             new law in Minnesota Statutes, chapter 325E. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1996, section 325E.26, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 1a.  [ABANDONED SOLICITATION.] "Abandoned 
  1.11  solicitation" means a call in which a telephone number is dialed 
  1.12  for the purposes of making or attempting to make a commercial 
  1.13  telephone solicitation and: 
  1.14     (1) the caller disconnects the call while the subscriber's 
  1.15  telephone is ringing but has not yet rung for 30 seconds; or 
  1.16     (2) the subscriber answers the call and no live operator is 
  1.17  immediately available to identify the entity or person making 
  1.18  the call. 
  1.19     Sec. 2.  Minnesota Statutes 1996, section 325E.26, is 
  1.20  amended by adding a subdivision to read: 
  1.21     Subd. 4a.  [PREDICTIVE DIALING DEVICE.] "Predictive dialing 
  1.22  device" means: 
  1.23     (1) a device or system that is designed or operated in such 
  1.24  a way that it selects or dials multiple telephone numbers such 
  1.25  that the number of telephone numbers dialed exceeds the number 
  1.26  of live operators assigned to speak to subscribers and available 
  2.1   to do so; or 
  2.2      (2) any other device or system used in connection with 
  2.3   commercial telephone solicitations that is designed or operated 
  2.4   in such a way that it is likely to result in abandoned 
  2.5   solicitations. 
  2.6      Sec. 3.  [325E.295] [PREDICTIVE DIALING DEVICES 
  2.7   PROHIBITED.] 
  2.8      No caller shall use any predictive dialing device.
