  1.2             relating to education; restoring training and 
  1.3             experience revenue; modifying the base year adjustment 
  1.4             for special education revenue; authorizing additional 
  1.5             flexibility for school boards when allocating 
  1.6             compensatory revenue; amending Minnesota Statutes 1997 
  1.7             Supplement, sections 124.3201, subdivision 3; 124A.04, 
  1.8             subdivision 2; and 124A.28, subdivision 1a. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 1997 Supplement, section 
  1.11  124.3201, subdivision 3, is amended to read: 
  1.12     Subd. 3.  [ADJUSTED SPECIAL EDUCATION BASE REVENUE.] For 
  1.13  fiscal year 1997 and later, a district's adjusted special 
  1.14  education base revenue equals the district's special education 
  1.15  base revenue times the ratio of the district's average daily 
  1.16  membership special education child count reported on the MARSS 
  1.17  system for the current school year to the district's average 
  1.18  daily membership special education child count reported on the 
  1.19  MARSS system for the base year.  
  1.20     Sec. 2.  Minnesota Statutes 1997 Supplement, section 
  1.21  124A.04, subdivision 2, is amended to read: 
  1.22     Subd. 2.  [1999 AND LATER.] The training and experience 
  1.23  index for fiscal year 1999 and later must be constructed in the 
  1.24  following manner:  
  1.25     (a) The department shall construct a matrix that classifies 
  1.26  teachers by the extent of training received in accredited 
  1.27  institutions of higher education and by the years of experience 
  2.1   that districts take into account in determining teacher salaries.
  2.2      (b) The average salary for each cell of the matrix must be 
  2.3   computed as follows using data from the current fiscal year 1997:
  2.4      (1) For each school district, multiply the salary paid to 
  2.5   full-time equivalent teachers with that combination of training 
  2.6   and experience according to the district's teacher salary 
  2.7   schedule by the number of actual pupil units in that district.  
  2.8      (2) Add the amounts computed in clause (1) for all 
  2.9   districts in the state and divide the resulting sum by the total 
  2.10  number of actual pupil units in all districts in the state that 
  2.11  employ teachers.  
  2.12     (c) For each cell in the matrix, compute the ratio of the 
  2.13  average salary in that cell to the average salary for all 
  2.14  teachers in the state during the current fiscal year 1997.  
  2.15     (d) The index for each district that employs teachers 
  2.16  equals the sum of:  (i) for teachers employed in that district 
  2.17  during fiscal year 1997 and the current fiscal year, the ratios 
  2.18  for each teacher computed using data for the current fiscal year 
  2.19  1997; and (ii) for teachers employed in that district during the 
  2.20  current fiscal year but not during fiscal year 1997, the ratio 
  2.21  for teachers who are in their first year of teaching and who 
  2.22  have no additional credits or degrees above a bachelor's degree 
  2.23  divided by the number of teachers in that district.  The index 
  2.24  for a district that employs no teachers is zero. 
  2.25     Sec. 3.  Minnesota Statutes 1997 Supplement, section 
  2.26  124A.28, subdivision 1a, is amended to read: 
  2.27     Subd. 1a.  [BUILDING ALLOCATION.] (a) A district must 
  2.28  allocate compensatory revenue to each school building in the 
  2.29  district where the children who have generated the revenue are 
  2.30  served except as provided in paragraph (b). 
  2.31     (b) A district may use up to 50 percent of its compensatory 
  2.32  revenue for district-wide, site-based compensatory education 
  2.33  programs if the school board notifies each school site 
  2.34  decision-making team of its intent to do so prior to adopting a 
  2.35  written resolution to use the revenue for district-wide, 
  2.36  site-based compensatory education programs. 
  3.1      (c) If the pupil is served at a site other than one owned 
  3.2   and operated by the district, the revenue shall be paid to the 
  3.3   district and used for services for pupils who generate the 
  3.4   revenue. 
  3.5      Sec. 4.  [EFFECTIVE DATE.] 
  3.6      Sections 1 to 3 are effective for revenue for fiscal year 
  3.7   1999 and later.
