A bill for an act
relating to environment; modifying provisions related to model standards and
criteria for development of shoreland; amending Minnesota Statutes 2022, section
103F.211, subdivision 1, by adding a subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2022, section 103F.211, subdivision 1, is amended to read:
The commissioner shall adopt model standards and criteria
for the subdivision, use, and development of shoreland in municipalities and areas outside
of a municipality. The standards and criteria must include:
(1) the area of a lot and length of water frontage suitable for a building site;
(2) the placement of structures in relation to shorelines and roads;
(3) the placement and construction of sanitary and waste disposal facilities;
(4) designation of types of land uses;
(5) changes in bottom contours of adjacent public waters;
(6) preservation of natural shorelands through the restriction of land uses;
(7) variances from the minimum standards and criteria; deleted text begin and

(8) for areas outside of a municipality only, a model ordinancenew text begin ; and

new text begin (9) an optional model shoreland planned urban development standard or ordinance that
municipalities and areas outside municipalities may, but are not required to, consider adopting
as an alternative to permitted or conditional uses in shorelands for residential planned urban
developments and commercial planned urban developments as defined by those municipalities

Minnesota Statutes 2022, section 103F.211, is amended by adding a subdivision
to read:

reasonableness according to section 14.131 before modifying a model standard or ordinance
under this section.
