A bill for an act
relating to local government; requiring published notice before decision to accept
grant money; amending Minnesota Statutes 2018, section 465.03.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2018, section 465.03, is amended to read:


465.03 GIFTS TO MUNICIPALITIES.

Any city, county, school district or town may accept
a grant or devise of real or personal property and maintain such property for the benefit of
its citizens in accordance with the terms prescribed by the donor. Nothing herein shall
authorize such acceptance or use for religious or sectarian purposes. Every such acceptance
shall be by resolution of the governing body adopted by a two-thirds majority of its members,
expressing such terms in full.

new text begin For any grant or gift with a value of $50,000 or greater, the local
government must publish notice of the pending grant or gift at least 14 days before the
meeting at which the governing body of the local government will vote to accept the grant
or gift. The local government must also post the notice on the local government's website,
if any. The notice must include identification of the grantor or donor, the amount or value
of the grant or gift, the intended use of the grant or gift, and the terms the local government
is agreeing to in accepting the grant or gift.
