  1.1                          A bill for an act 
  1.2             relating to economic development authorities; 
  1.3             authorizing their establishment by counties under 
  1.4             certain conditions; amending Minnesota Statutes 1996, 
  1.5             section 469.091, subdivision 1. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1996, section 469.091, 
  1.8   subdivision 1, is amended to read: 
  1.9      Subdivision 1.  [ESTABLISHMENT.] (a) A city may, by 
  1.10  adopting an enabling resolution in compliance with the 
  1.11  procedural requirements of section 469.093, establish an 
  1.12  economic development authority that, subject to section 469.092, 
  1.13  has the powers contained in sections 469.090 to 469.108 and the 
  1.14  powers of a housing and redevelopment authority under sections 
  1.15  469.001 to 469.047 or other law, and of a city under sections 
  1.16  469.124 to 469.134 or other law.  If the economic development 
  1.17  authority exercises the powers of a housing and redevelopment 
  1.18  authority contained in sections 469.001 to 469.047 or other law, 
  1.19  the city shall exercise the powers relating to a housing and 
  1.20  redevelopment authority granted to a city by sections 469.001 to 
  1.21  469.047 or other law.  
  1.22     (b) A county may establish an economic development 
  1.23  authority in the manner provided in sections 469.090 to 
  1.24  469.1081, and may impose limits on the authority as enumerated 
  1.25  in section 469.092.  A county economic development authority may 
  2.1   create and define the boundaries of economic development 
  2.2   districts at any place or places within the county, provided 
  2.3   that a project as recommended by the county authority that is to 
  2.4   be located within the corporate limits of a city may not be 
  2.5   commenced without the approval of the governing body of the city.
  2.6   Section 469.174, subdivision 10, and the contiguity requirement 
  2.7   specified under section 469.101, subdivision 1, do not apply to 
  2.8   limit the areas that may be designated as county economic 
  2.9   development districts.  If an economic development authority is 
  2.10  established by a county, the county may exercise all of the 
  2.11  powers relating to an economic development authority granted to 
  2.12  a city under sections 469.090 to 469.1081, or other law, 
  2.13  including the power to levy a tax to support the activities of 
  2.14  the authority.
