  1.1                          A bill for an act
  1.2             relating to occupational safety and health; 
  1.3             prohibiting the operation of cranes by individuals who 
  1.4             do not possess crane operator certificates; providing 
  1.5             penalties; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 182. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [182.6525] [CRANE OPERATION.] 
  1.9      Subdivision 1.  [GENERALLY.] No employer or general 
  1.10  contractor may permit an individual to operate a crane unless 
  1.11  the employee has a valid crane operator certificate issued by 
  1.12  the National Commission for the Certification of Crane Operators 
  1.13  or an entity accredited for crane operator certification by the 
  1.14  National Commission for Certifying Agencies.  For purposes of 
  1.15  this section, "crane" means a power-operated hoisting machine 
  1.16  that is used in construction, demolition, or excavation work, 
  1.17  that has a power-operated winch and load line, and that has a 
  1.18  power-operated boom that moves laterally by the rotation of the 
  1.19  machine on a carrier.  Crane does not include a forklift, digger 
  1.20  derrick truck, or bucket truck. 
  1.21     Subd. 2.  [PROOF OF CERTIFICATION.] An individual who is 
  1.22  operating a crane on a work site shall provide proof of 
  1.23  certification upon request by an Occupational Safety and Health 
  1.24  Administration investigator. 
  1.25     Subd. 3.  [INDIVIDUALS WHO HAVE PASSED TEST.] An employer 
  1.26  or general contractor may permit an individual to operate the 
  2.1   crane so long as the individual has passed the written portion 
  2.2   of the certification exam within the previous 12 months and is 
  2.3   supervised on site by an individual who has a valid crane 
  2.4   operator certificate.  The individual must be able to present 
  2.5   upon request written evidence of successful completion of the 
  2.6   written exam. 
  2.7      Subd. 4.  [PENALTIES.] An employer or general contractor 
  2.8   may be cited by the commissioner for a violation of the 
  2.9   certification requirements in this section.  A citation is 
  2.10  punishable as a serious violation under section 182.666. 
  2.11     Sec. 2.  [EFFECTIVE DATE.] 
  2.12     Section 1 is effective January 1, 2004.
