A bill for an act
 relating to child protection; modifying financial responsibility for out-of-state
children; amending Minnesota Statutes 2006, section 260.855.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2006, section 260.855, is amended to read:


260.855 FINANCIAL RESPONSIBILITY.

new text begin (a) new text end Financial responsibility for any child placed pursuant to the provisions of the
Interstate Compact on the Placement of Children shall be determined in accordance with
the provisions of article 5 thereof in the first instance. However, in the event of partial
or complete default of performance thereunder, the provisions of sections 518C.101 to
518C.902 also may be invoked.

new text begin (b) In the event of partial or complete default of performance, or in the case of
a child placement in violation of the compact, the Department of Human Services is
financially responsible for the costs of the child's placement. The county of the child's
placement shall bear no financial responsibility for the placement.
