  1.1                          A bill for an act 
  1.2             relating to peace officers; extending peace officer 
  1.3             discipline procedures to include correctional officers 
  1.4             employed by the department of corrections; amending 
  1.5             Minnesota Statutes 1994, section 626.89, subdivisions 
  1.6             1 and 2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 626.89, 
  1.9   subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [DEFINITIONS.] For purposes of this 
  1.11  section, the terms defined in this subdivision have the meanings 
  1.12  given them. 
  1.13     (a) "Administrative hearing" means a nonjudicial hearing or 
  1.14  arbitration authorized to recommend, approve, or order 
  1.15  discipline. 
  1.16     (b) "Formal statement" means the questioning of an officer 
  1.17  in the course of obtaining a recorded, stenographic, or signed 
  1.18  statement to be used as evidence in a disciplinary proceeding 
  1.19  against the officer. 
  1.20     (c) "Officer" means a licensed peace officer or part-time 
  1.21  peace officer, as defined in section 626.84, subdivision 1, 
  1.22  paragraphs (c) and (f), who is employed by a unit of government, 
  1.23  or a correctional officer employed by the department of 
  1.24  corrections. 
  1.25     Sec. 2.  Minnesota Statutes 1994, section 626.89, 
  1.26  subdivision 2, is amended to read: 
  2.1      Subd. 2.  [APPLICABILITY.] The procedures and provisions of 
  2.2   this section apply to law enforcement agencies and, government 
  2.3   units, and the department of corrections.  The procedures and 
  2.4   provisions of this section do not apply to: 
  2.5      (1) investigations and proceedings of the Minneapolis 
  2.6   civilian police review authority; or 
  2.7      (2) investigations of criminal charges against an officer.
