A bill for an act
relating to natural resources; requiring wetland notification prior to sale of real
property; proposing coding for new law in Minnesota Statutes, chapter 103G.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

(a) Before signing an agreement to sell or transfer real property, the seller must
disclose the existence and location of any wetlands on the property as certified by the
county under paragraph (b).

(b) A county must provide to an owner of real property, upon request, written
certification necessary to satisfy the requirements of paragraph (a) within 60 days after
the date that weather conditions permit full wetland delineation determination. The
certification must include a determination of whether or not a wetland exists on the
property and, if so, the exact location of the wetlands. A county may charge a fee to the
owner of real property requesting wetland certification under this section. The fee shall
not exceed the amount necessary to cover the costs of providing the certification.
