  1.1                          A bill for an act 
  1.2             relating to land use planning; modifying housing 
  1.3             requirements for local comprehensive plans in 
  1.4             metropolitan areas; amending Minnesota Statutes 2000, 
  1.5             section 473.859, subdivision 4; Minnesota Statutes 
  1.6             2001 Supplement, section 473.859, subdivision 2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2001 Supplement, section 
  1.9   473.859, subdivision 2, is amended to read: 
  1.10     Subd. 2.  [LAND USE PLAN.] (a) A land use plan shall 
  1.11  include the water management plan required by section 103B.235, 
  1.12  and shall designate the existing and proposed location, 
  1.13  intensity and extent of use of land and water, including lakes, 
  1.14  wetlands, rivers, streams, natural drainage courses, and 
  1.15  adjoining land areas that affect water natural resources, for 
  1.16  agricultural, residential, commercial, industrial and other 
  1.17  public and private purposes, or any combination of such purposes.
  1.18     (b) A land use plan shall contain a protection element, as 
  1.19  appropriate, for historic sites, the matters listed in the water 
  1.20  management plan required by section 103B.235, and an element for 
  1.21  protection and development of access to direct sunlight for 
  1.22  solar energy systems.  
  1.23     (c) A land use plan shall also include a housing element 
  1.24  containing standards, plans and programs for providing adequate 
  1.25  housing opportunities to meet existing and projected local and 
  1.26  regional housing needs, including but not limited to the use of 
  2.1   official controls and land use planning to promote the 
  2.2   availability of land for the development of low and moderate 
  2.3   income housing.  
  2.4      (d) A land use plan shall also include the local 
  2.5   government's goals, intentions, and priorities concerning 
  2.6   aggregate and other natural resources, transportation 
  2.7   infrastructure, land use compatibility, habitat, agricultural 
  2.8   preservation, and other planning priorities, considering 
  2.9   information regarding supply from the Minnesota geological 
  2.10  survey information circular No. 46. 
  2.11     Sec. 2.  Minnesota Statutes 2000, section 473.859, 
  2.12  subdivision 4, is amended to read: 
  2.13     Subd. 4.  [IMPLEMENTATION PROGRAM.] An implementation 
  2.14  program shall describe public programs, fiscal devices and other 
  2.15  specific actions to be undertaken in stated sequence to 
  2.16  implement the comprehensive plan and ensure conformity with 
  2.17  metropolitan system plans.  An implementation program must be in 
  2.18  at least such detail as may be necessary to establish existing 
  2.19  or potential effects on or departures from metropolitan system 
  2.20  plans and to protect metropolitan system plans.  An 
  2.21  implementation program shall contain at least the following 
  2.22  parts: 
  2.23     (1) a description of official controls, addressing at least 
  2.24  the matters of zoning, subdivision, water supply, and private 
  2.25  sewer systems, and a schedule for the preparation, adoption, and 
  2.26  administration of such controls; 
  2.27     (2) a capital improvement program for transportation, 
  2.28  sewers, parks, water supply, and open space facilities; and 
  2.29     (3) a housing implementation program, including official 
  2.30  controls to implement the housing element of the land use plan, 
  2.31  which will provide sufficient existing and new housing to meet 
  2.32  the local unit's share of the metropolitan area need for low and 
  2.33  moderate income housing.
