  1.1                          A bill for an act 
  1.2             relating to education; requiring money from certain 
  1.3             federal education programs to be appropriated year by 
  1.4             year; amending Minnesota Statutes 2000, section 4.07, 
  1.5             subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 2000, section 4.07, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [FEDERAL AND STATE LAW; APPROPRIATION OF FUNDS.] 
  1.10  (a) The governor or any state department or agency designated by 
  1.11  the governor shall comply with any and all requirements of 
  1.12  federal law and any rules and regulations promulgated thereunder 
  1.13  to enable the application for, the receipt of, and the 
  1.14  acceptance of such federal funds.  The expenditure of any such 
  1.15  funds received shall be governed by the laws of the state except 
  1.16  insofar as federal requirements may otherwise provide.  All such 
  1.17  money received by the governor or any state department or agency 
  1.18  designated by the governor for such purpose shall be deposited 
  1.19  in the state treasury and, subject to section 3.3005, are hereby 
  1.20  appropriated annually in order to enable the governor or the 
  1.21  state department or agency designated by the governor for such 
  1.22  purpose to carry out the purposes for which the funds are 
  1.23  received.  None of such federal money so deposited in the state 
  1.24  treasury shall cancel and they shall be available for 
  1.25  expenditure in accordance with the requirements of federal law.  
  2.1      (b) Notwithstanding paragraph (a), money received according 
  2.2   to the authorization in the federal law designated as Title 1 of 
  2.3   the Elementary and Secondary Education Act are not appropriated 
  2.4   in this subdivision and are available for expenditure only after 
  2.5   being appropriated for a specific year in a law.
