  1.2             relating to education; permitting school board 
  1.3             approval of additional operating revenue; amending 
  1.4             Minnesota Statutes 2001 Supplement, section 126C.17, 
  1.5             subdivision 1; proposing coding for new law in 
  1.6             Minnesota Statutes, chapter 126C. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 2001 Supplement, section 
  1.9   126C.17, subdivision 1, is amended to read: 
  1.10     Subdivision 1.  [REFERENDUM ALLOWANCE.] (a) For fiscal year 
  1.11  2002, a district's referendum revenue allowance equals the sum 
  1.12  of the allowance under section 126C.16, subdivision 2 3, plus 
  1.13  any additional allowance per resident marginal cost pupil unit 
  1.14  authorized under subdivision 9 for fiscal year 2002. 
  1.15     (b) For fiscal year 2003 and later, a district's initial 
  1.16  referendum revenue allowance equals the sum of the allowance 
  1.17  under section 126C.16, subdivision 2 3, plus any additional 
  1.18  allowance per resident marginal cost pupil unit authorized under 
  1.19  subdivision 9 before May 1, 2001, for fiscal year 2002 and 
  1.20  later, plus the referendum conversion allowance approved under 
  1.21  subdivision 13, minus $415.  For districts with more than one 
  1.22  referendum authority, the reduction must be computed separately 
  1.23  for each authority.  The reduction must be applied first to the 
  1.24  referendum conversion allowance and next to the authority with 
  1.25  the earliest expiration date.  A district's initial referendum 
  1.26  revenue allowance may not be less than zero. 
  2.1      (c) For fiscal year 2003 and later, a district's referendum 
  2.2   revenue allowance equals the initial referendum allowance plus 
  2.3   any additional allowance per resident marginal cost pupil unit 
  2.4   authorized under subdivision 9 after April 30, 2001, for fiscal 
  2.5   year 2003 and later. 
  2.6      (d) For fiscal year 2004 and later, a district's referendum 
  2.7   revenue allowance under this subdivision may be increased by an 
  2.8   amount approved under section 126C.75. 
  2.9      [EFFECTIVE DATE.] This section is effective for taxes 
  2.10  payable in 2003 and later. 
  2.11     Sec. 2.  [126C.75] [SCHOOL BOARD APPROVED REFERENDUM 
  2.12  REVENUE.] 
  2.13     (a) A school board by resolution may approve additional 
  2.14  operating revenue.  The approved amount must be stated as an 
  2.15  amount per resident marginal cost pupil unit. 
  2.16     (b) The board must prepare and deliver by first class mail 
  2.17  at least 15 days but no more than 30 days before the day of the 
  2.18  board hearing to each taxpayer a notice of the hearing and the 
  2.19  proposed revenue increase.  The board need not mail more than 
  2.20  one notice to any taxpayer.  For the purpose of giving mailed 
  2.21  notice under this paragraph, owners must be those shown to be 
  2.22  owners on the records of the county auditor or, in any county 
  2.23  where tax statements are mailed by the county treasurer, on the 
  2.24  records of the county treasurer.  Every property owner whose 
  2.25  name does not appear on the records of the county auditor or the 
  2.26  county treasurer is deemed to have waived this mailed notice 
  2.27  unless the owner has requested in writing that the county 
  2.28  auditor or county treasurer, as the case may be, include the 
  2.29  name on the records for this purpose.  The notice must project 
  2.30  the anticipated amount of tax increase in annual dollars and 
  2.31  annual percentage for typical residential homesteads, 
  2.32  agricultural homesteads, apartments, and commercial-industrial 
  2.33  property within the school district. 
  2.34     The notice must include the following statement:  "If the 
  2.35  school board approves this resolution, it will result in an 
  2.36  increase in your property taxes."  However, in cases of renewing 
  3.1   existing levies, the notice may include the following 
  3.2   statement:  "If the school board approves this resolution, it 
  3.3   may result in an increase in your property taxes." 
  3.4      [EFFECTIVE DATE.] This section is effective for taxes 
  3.5   payable in 2003 and later.
