  1.1                          A bill for an act 
  1.2             relating to drivers' licenses; allowing business 
  1.3             access to driver's license photograph under certain 
  1.4             conditions; amending Minnesota Statutes 1998, section 
  1.5             171.07, subdivision 1a. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1998, section 171.07, 
  1.8   subdivision 1a, is amended to read: 
  1.9      Subd. 1a.  [FILING PHOTOGRAPH OR IMAGE; DATA 
  1.10  CLASSIFICATION.] The department shall file, or contract to file, 
  1.11  all photographs or electronically produced images obtained in 
  1.12  the process of issuing driver licenses or Minnesota 
  1.13  identification cards.  The photographs or electronically 
  1.14  produced images shall be are private data pursuant to section 
  1.15  13.02, subdivision 12.  Notwithstanding section 13.04, 
  1.16  subdivision 3, the department shall is not be required to 
  1.17  provide copies of photographs or electronically produced images 
  1.18  to data subjects.  The use of the files is restricted: 
  1.19     (1) to the issuance and control of driver drivers' 
  1.20  licenses; 
  1.21     (2) for law enforcement purposes in the investigation and 
  1.22  prosecution of crimes; and 
  1.23     (3) for use in systems designed to prevent financial 
  1.24  transaction and identity fraud, provided that: 
  1.25     (i) the systems are audited by the department; and 
  2.1      (ii) the subject of the photo or image consents to its use; 
  2.2   and 
  2.3      (iii) no further dissemination of the photo or image 
  2.4   occurs; and 
  2.5      (4) for child support enforcement purposes under section 
  2.6   256.978.
