  1.7             Statutes, chapter 243. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9   Section 1.  [CAPITAL IMPROVEMENTS APPROPRIATIONS.] 
  1.10     The sums in the column under "APPROPRIATIONS" are 
  1.11  appropriated from the bond proceeds fund, or another named fund, 
  1.12  to the state agencies or officials indicated, to be spent to 
  1.13  acquire and to better public land and buildings and other public 
  1.14  improvements of a capital nature, as specified in this act.

  1.22  Subdivision 1.  To the 
  1.23  commissioner of administration, or the
  1.24  commissioner of corrections, if so
  1.25  specified, for the purposes specified

  1.27  It is the policy of the state to 
  1.28  convert existing, surplus state 
  1.29  property for use as correctional 
  1.30  facilities, rather than construct new 
  2.1   facilities, whenever surplus state 
  2.2   property is available and appropriate 
  2.3   for conversion.  Conversion of existing 
  2.4   facilities recycles buildings and 
  2.5   materials, and provides opportunities 
  2.6   for current and former state employees 
  2.7   to continue their careers without the 
  2.8   total disruption that relocation 
  2.9   entails. 
  2.10  Subd. 2.  New Correctional Facility
  2.11   - Rush City                                          99,999,000
  2.12  To complete design and to construct, 
  2.13  furnish, and equip a new close custody 
  2.14  correctional facility to provide up to 
  2.15  800 beds at Rush City. 
  2.16  Subd. 3.  Bed Expansion for
  2.17  Geriatric Inmates - Ah Gwah Ching                     1,500,000
  2.18  To predesign, design, remodel, and 
  2.19  construct new space for beds for 
  2.20  geriatric inmates and inmates with 
  2.21  special medical needs at the Minnesota 
  2.22  correctional facility - Ah Gwah Ching. 
  2.23  The commissioners of corrections and 
  2.24  human services must enter into 
  2.25  agreements to establish the 
  2.26  correctional facility at Ah Gwah Ching 
  2.27  with appropriations available for this 
  2.28  purpose.  The commissioner of 
  2.29  corrections shall ensure that the 
  2.30  facility is available for the placement 
  2.31  of persons committed to the 
  2.32  commissioner by December 31, 1996. 
  2.33  Subd. 4.  Minnesota Correctional 
  2.34  Facility - Lino Lakes                                   842,000
  2.35  For site preparation, predesign, and 
  2.36  design of a segregation unit for up to 
  2.37  80 medium security beds. 
  2.38  Subd. 5.  Third Judicial District
  2.39  Regional Juvenile Treatment Center                      680,000
  2.40  To the commissioner of corrections for 
  2.41  a grant to Olmstead county.  The grant 
  2.42  is to design, remodel, equip, and 
  2.43  furnish building No. 7 on the campus of 
  2.44  the former Rochester State Hospital.  
  2.45  The remodeled building is to be used 
  2.46  for juvenile sex offenders and 
  2.47  predelinquent or delinquent youths as a 
  2.48  part of an integrated, comprehensive 
  2.49  juvenile services model for the third 
  2.50  judicial district. For purposes of this 
  2.51  grant, Olmstead county is the fiscal 
  2.52  agent for participating counties. 
  2.53  Subd. 6.  Asset Preservation                          2,000,000
  2.54  For unanticipated emergencies of a 
  2.55  capital nature, projects to remove life 
  2.56  safety hazards and code violations, 
  2.57  elimination or containment of hazardous 
  2.58  substances, and replacement and repair 
  2.59  of roofs, windows, building components, 
  2.60  HVAC systems, and other capital assets, 
  3.1   in facilities managed by the 
  3.2   commissioner of corrections. 
  3.3   By December 31 of each year, the 
  3.4   commissioner of corrections shall 
  3.5   submit a list of the projects that have 
  3.6   received bond proceeds during that 
  3.7   calendar year from this appropriation 
  3.8   to the chairs of the crime prevention 
  3.9   finance divisions, the senate finance 
  3.10  committee, the house capital investment 
  3.11  committee, and the commissioner of 
  3.12  finance.  This appropriation is exempt 
  3.13  from the requirements of Minnesota 
  3.14  Statutes, section 16B.335. 
  3.15  Subd. 7.  Minnesota Correctional 
  3.16  Facility - Stillwater                                 2,581,000
  3.17  For predesign and design of a health 
  3.18  services center providing up to 50 
  3.19  regular medical beds, 30 transition 
  3.20  beds, and 20 mental health beds. 
  3.21  Subd. 8.  Minnesota Correctional 
  3.22  Facility - Oak Park Heights                             600,000
  3.23  For predesign, design, and preparation 
  3.24  of construction documents for the 
  3.25  addition of a 60-bed, special high 
  3.26  security housing unit at Oak Park 
  3.27  Heights for extremely high risk inmates.
  3.28  Subd. 9.  Alternative to Incarceration
  3.29  Centers, Second Judicial District                     1,000,000
  3.30  To the commissioner of corrections for 
  3.31  a grant to Ramsey county to design, 
  3.32  remodel, equip, and furnish facilities 
  3.33  in Ramsey county to provide programs 
  3.34  for juveniles who are at risk of 
  3.35  incarceration.  This appropriation is 
  3.36  contingent upon a match of an equal 
  3.37  amount from nonstate sources. 
  3.38  Subd. 10.  Inmate    
  3.39  Bed Expansion - Brainerd                                       
  3.40  The commissioners of human services and 
  3.41  corrections shall explore the need for 
  3.42  a secure mental health treatment 
  3.43  facility for mentally ill inmates, and 
  3.44  shall consider the feasibility of 
  3.45  establishing the facility in buildings 
  3.46  at the Brainerd regional human services 
  3.47  center.  The commissioners shall report 
  3.48  their findings to the legislature by 
  3.49  December 1, 1996. 
  3.50  $1,500,000 of the appropriation in Laws 
  3.51  1990, chapter 610, article 1, section 
  3.52  12, subdivision 8, to remodel 
  3.53  residential buildings at regional 
  3.54  treatment centers for skilled nursing 
  3.55  facilities, is reappropriated to the 
  3.56  commissioner of administration for 
  3.57  capital improvements to the Brainerd 
  3.58  regional human services center to 
  3.59  establish a correctional facility for 
  3.60  medium and minimum security inmates and 
  3.61  to establish a special unit for inmates 
  4.1   with mental illness.  This amount is 
  4.2   available for this purpose only if the 
  4.3   commissioner of corrections has found 
  4.4   that a secure mental health treatment 
  4.5   facility is needed. 
  4.6   Subd. 11.   Minnesota Correctional 
  4.7   Facility - St. Cloud                                  2,381,000
  4.8   To design, construct, furnish, equip, 
  4.9   and relocate visiting, laundry, and 
  4.10  X-ray rooms.

  4.38  400-bed adult male close custody 
  4.39  facility.  
  4.40     Sec. 3.  [243.95] [THE MINNESOTA CORRECTIONAL FACILITY - AH 
  4.41  GWAH CHING.] 
  4.42     The Minnesota correctional facility - Ah Gwah Ching is 
  4.43  established at Ah Gwah Ching, Minnesota.  The general control 
  4.44  and management of the facility shall be under the commissioner 
  4.45  of corrections, who shall operate it as a minimum security adult 
  4.46  correctional facility for geriatric and medical care. 
  4.47     Sec. 4.  [BOND SALE AUTHORIZATION.] 
  4.48     To provide the money appropriated in this act from the bond 
  4.49  proceeds fund the commissioner of finance, on request of the 
  5.1   governor, shall sell and issue bonds of the state in an amount 
  5.2   up to $116,973,000 in the manner, upon the terms, and with the 
  5.3   effect prescribed by Minnesota Statutes, sections 16A.631 to 
  5.4   16A.675, and by the Minnesota Constitution, article XI, sections 
  5.5   4 to 7.
