  1.1                          A bill for an act 
  1.2             relating to capital improvements; appropriating money 
  1.3             to construct an economic development facility on the 
  1.4             Red Lake Indian reservation; canceling part of an 
  1.5             appropriation; authorizing the sale of state bonds. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [RED LAKE ECONOMIC DEVELOPMENT.] 
  1.8      Subdivision 1.  [APPROPRIATION.] (a) $1,400,000 is 
  1.9   appropriated from the bond proceeds fund to the commissioner of 
  1.10  administration to plan, design, construct, furnish, and equip an 
  1.11  economic development facility on the Red Lake Indian reservation.
  1.12     (b) The facility must be constructed on land leased to the 
  1.13  state by the Red Lake Band of Chippewa Indians.  The ground 
  1.14  lease must be executed by the commissioner of administration 
  1.15  under Minnesota Statutes, section 16B.24, subdivision 6, except 
  1.16  that the initial term of the ground lease must be at least 20 
  1.17  years and the total term must be at least 40 years, including 
  1.18  renewal options. 
  1.19     (c) Construction of the facility is not subject to the 
  1.20  competitive bidding requirements of Minnesota Statutes, chapter 
  1.21  16C.  The commissioner may contract directly with the Red Lake 
  1.22  Tribal Council to complete the facility.  
  1.23     (d) The commissioner must enter into an agreement with the 
  1.24  Red Lake Tribal Council under Minnesota Statutes, section 
  1.25  16A.695, to operate the facility on behalf of the state to carry 
  2.1   out the state program of economic development during the term of 
  2.2   the ground lease and any renewal options. 
  2.3      Subd. 2.  [CANCELLATION.] $500,000 of the appropriation in 
  2.4   Laws 1998, chapter 404, section 23, subdivision 27, for a 
  2.5   production facility associated with an educational and training 
  2.6   facility on the Red Lake Indian reservation, is canceled to the 
  2.7   general fund. 
  2.8      Subd. 3.  [BOND SALE.] To provide the money appropriated in 
  2.9   this act from the bond proceeds fund, the commissioner of 
  2.10  finance shall sell and issue bonds of the state in an amount up 
  2.11  to $1,400,000 in the manner, upon the terms, and with the effect 
  2.12  prescribed by Minnesota Statutes, sections 16A.631 to 16A.675, 
  2.13  and by the Minnesota Constitution, article XI, sections 4 to 7. 
  2.14     Sec. 2.  [EFFECTIVE DATE.] 
  2.15     This act is effective the day following final enactment.
