  1.1                          A bill for an act 
  1.2             relating to alcoholic beverages; authorizing cities to 
  1.3             issue on-sale intoxicating liquor, wine, and malt 
  1.4             liquor licenses to theaters; amending Minnesota 
  1.5             Statutes 1998, sections 340A.101, by adding a 
  1.6             subdivision; 340A.404, subdivision 1; and 340A.413, 
  1.7             subdivision 4. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1998, section 340A.101, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 27a.  [THEATER.] "Theater" means a building 
  1.12  containing an auditorium in which live dramatic, musical, dance, 
  1.13  or literary performances are regularly presented to holders of 
  1.14  tickets for those performances. 
  1.15     Sec. 2.  Minnesota Statutes 1998, section 340A.404, 
  1.16  subdivision 1, is amended to read: 
  1.17     Subdivision 1.  [CITIES.] (a) A city may issue an on-sale 
  1.18  intoxicating liquor license to the following establishments 
  1.19  located within its jurisdiction: 
  1.20     (1) hotels; 
  1.21     (2) restaurants; 
  1.22     (3) bowling centers; 
  1.23     (4) clubs or congressionally chartered veterans 
  1.24  organizations with the approval of the commissioner, provided 
  1.25  that the organization has been in existence for at least three 
  1.26  years and liquor sales will only be to members and bona fide 
  2.1   guests; 
  2.2      (5) sports facilities located on land owned by the 
  2.3   metropolitan sports commission; and 
  2.4      (6) exclusive liquor stores.  
  2.5      (b) A city may issue an on-sale intoxicating liquor 
  2.6   license, an on-sale wine license, or an on-sale malt liquor 
  2.7   license to a theater within the city.  A license issued under 
  2.8   this paragraph authorizes sales on all days of the week. 
  2.9      Sec. 3.  Minnesota Statutes 1998, section 340A.413, 
  2.10  subdivision 4, is amended to read: 
  2.11     Subd. 4.  [EXCLUSIONS FROM LICENSE LIMITS.] On-sale 
  2.12  intoxicating liquor licenses may be issued to the following 
  2.13  entities by a city, in addition to the number authorized by this 
  2.14  section: 
  2.15     (1) clubs, or congressionally chartered veterans 
  2.16  organizations; 
  2.17     (2) restaurants located at a racetrack licensed under 
  2.18  chapter 240; 
  2.19     (3) establishments that are issued licenses to sell wine 
  2.20  under section 340A.404, subdivision 5; and 
  2.21     (4) theaters that are issued licenses under section 
  2.22  340A.404, subdivision 1, paragraph (b), or 2. 
  2.23     Sec. 4.  [EFFECTIVE DATE.] 
  2.24     Sections 1 to 3 are effective the day following final 
  2.25  enactment.
