  1.1                          A bill for an act 
  1.2             relating to elections; permitting simultaneous 
  1.3             candidacy for nomination by major and minor parties 
  1.4             with their consent under certain conditions; amending 
  1.5             Minnesota Statutes 1994, sections 200.02, subdivision 
  1.6             7, and by adding a subdivision; 204B.04, subdivision 
  1.7             2, and by adding a subdivision; 204D.10, subdivision 
  1.8             2; 204D.12; and 204D.13, by adding a subdivision; 
  1.9             Minnesota Statutes 1995 Supplement, section 204B.06, 
  1.10            subdivision 1. 
  1.11  BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.12     Section 1.  Minnesota Statutes 1994, section 200.02, 
  1.13  subdivision 7, is amended to read: 
  1.14     Subd. 7.  [MAJOR POLITICAL PARTY.] "Major political party" 
  1.15  means a political party that maintains a party organization in 
  1.16  the state, political division or precinct in question and: 
  1.17     (a) Which (1) that has presented at least one candidate for 
  1.18  election to a partisan office at the last preceding state 
  1.19  general election, which candidate who received votes in each 
  1.20  county in that election and received votes from not less than 
  1.21  five percent of the total number of individuals who voted in 
  1.22  that election; or 
  1.23     (b) (2) whose members present to the secretary of state a 
  1.24  petition for a place on the state partisan primary ballot, which 
  1.25  a petition that contains signatures of a number of the party 
  1.26  members equal to at least five percent of the total number of 
  1.27  individuals who voted in the preceding state general election. 
  1.28     Votes cast for a candidate who was the nominee of more than 
  2.1   one political party in a state general election are not counted 
  2.2   in determining whether a minor political party should become a 
  2.3   major political party under clause (1). 
  2.4      Sec. 2.  Minnesota Statutes 1994, section 200.02, is 
  2.5   amended by adding a subdivision to read: 
  2.6      Subd. 22.  [MINOR POLITICAL PARTY.] "Minor political party" 
  2.7   means a political party that is not a major political party as 
  2.8   defined by subdivision 7 and that has adopted a state 
  2.9   constitution, designated a state party chair, and 
  2.10     (1) has presented at least one candidate: 
  2.11     (i) for a partisan office voted on statewide at the 
  2.12  preceding state general election who received votes in each 
  2.13  county that in the aggregate equal at least one percent of the 
  2.14  total number of individuals who voted in the election; or 
  2.15     (ii) for a legislative office who received votes from at 
  2.16  least ten percent of the total number of individuals who voted 
  2.17  for that office; or 
  2.18     (2) whose members present to the secretary of state a 
  2.19  petition containing the signatures of party members in a number 
  2.20  equal to: 
  2.21     (i) at least one percent of the total number of individuals 
  2.22  voting in the preceding state general election; or 
  2.23     (ii) at least ten percent of the total number of 
  2.24  individuals voting in the preceding state general election for a 
  2.25  legislative office for which the party presented a candidate. 
  2.26     Sec. 3.  Minnesota Statutes 1994, section 204B.04, 
  2.27  subdivision 2, is amended to read: 
  2.28     Subd. 2.  [CANDIDATES SEEKING NOMINATION BY PRIMARY.] No 
  2.29  individual who seeks nomination for any partisan or nonpartisan 
  2.30  office at a primary shall be nominated for the same office by 
  2.31  nominating petition, except as otherwise provided for partisan 
  2.32  offices in section 204D.10, subdivision 2 simultaneous 
  2.33  nominations in section 4, and for nonpartisan offices in section 
  2.34  204B.13, subdivision 4.  A major party candidate who fails to be 
  2.35  nominated at the state primary may not be listed on any ballot 
  2.36  at the subsequent state general election, except to fill a 
  3.1   vacancy as provided in section 204B.13. 
  3.2      Sec. 4.  Minnesota Statutes 1994, section 204B.04, is 
  3.3   amended by adding a subdivision to read: 
  3.4      Subd. 2a.  [SIMULTANEOUS NOMINATION.] A candidate may seek 
  3.5   the nomination of a major political party and one or more minor 
  3.6   political parties for the same partisan office simultaneously if 
  3.7   the state chair of the parties whose nomination is sought 
  3.8   consents in writing to the simultaneous nomination.  The forms 
  3.9   for written consent of the party chair must be prepared in the 
  3.10  manner provided by the secretary of state.  A candidate may not 
  3.11  be nominated by petition for a partisan office without the 
  3.12  written consent of the candidate. 
  3.13     A candidate who seeks the simultaneous nomination of a 
  3.14  major political party and one or more minor political parties 
  3.15  and fails to be nominated at the state primary for the major 
  3.16  political party forfeits the nominations of the minor political 
  3.17  parties. 
  3.18     A candidate may not seek the nomination of either a major 
  3.19  or minor political party, or both, and file a nominating 
  3.20  petition as an independent candidate for the same election. 
  3.21     Sec. 5.  Minnesota Statutes 1995 Supplement, section 
  3.22  204B.06, subdivision 1, is amended to read: 
  3.23     Subdivision 1.  [FORM OF AFFIDAVIT.] An affidavit of 
  3.24  candidacy shall state the name of the office sought and shall 
  3.25  state that the candidate:  
  3.26     (a) is an eligible voter; 
  3.27     (b) has no other affidavit on file as a candidate for any 
  3.28  other office at the same primary or next ensuing general 
  3.29  election, except that a candidate for soil and water 
  3.30  conservation district supervisor in a district not located in 
  3.31  whole or in part in Anoka, Hennepin, Ramsey, or Washington 
  3.32  county, may also have on file an affidavit of candidacy for 
  3.33  mayor or council member of a statutory or home rule charter city 
  3.34  of not more than 2,500 population contained in whole or in part 
  3.35  in the soil and water conservation district or for town 
  3.36  supervisor in a town of not more than 2,500 population contained 
  4.1   in whole or in part in the soil and water conservation district; 
  4.2   and 
  4.3      (c) is, or will be on assuming the office, 21 years of age 
  4.4   or more, and will have maintained residence in the district from 
  4.5   which the candidate seeks election for 30 days before the 
  4.6   general election; and 
  4.7      (d) accepts the nomination, if nominated by petition. 
  4.8      An affidavit of candidacy must include a statement that the 
  4.9   candidate's name as written on the affidavit for ballot 
  4.10  designation is the candidate's true name or the name by which 
  4.11  the candidate is commonly and generally known in the community. 
  4.12     An affidavit of candidacy for partisan office shall also 
  4.13  state the name of the candidate's political party or political 
  4.14  principle, stated in three words or less.  
  4.15     A candidate seeking the simultaneous nomination of a major 
  4.16  political party and one or more minor political parties shall 
  4.17  include the consent forms from the party chairs required by 
  4.18  section 204B.04, subdivision 2a, with the affidavit of candidacy.
  4.19     Sec. 6.  Minnesota Statutes 1994, section 204D.10, 
  4.20  subdivision 2, is amended to read: 
  4.21     Subd. 2.  [PARTY PRIMARY; TEN PERCENT REQUIREMENT.] If at 
  4.22  the state primary any individual seeking a major political 
  4.23  party's nomination for an office receives a number of votes 
  4.24  equal to ten percent of the average of the votes cast at the 
  4.25  last state general election for state officers of that major 
  4.26  political party within the district for which the office is 
  4.27  voted, then all candidates of that major political party who 
  4.28  receive the highest vote for an office are the nominees of that 
  4.29  major political party.  If none of the candidates of a major 
  4.30  political party receive the required ten percent, then no 
  4.31  candidates are nominated, and all the candidates of that major 
  4.32  political party may be nominated by nominating petition as 
  4.33  provided in sections 204B.07 to 204B.09.  The nominating 
  4.34  petitions provided for in this subdivision may only be signed 
  4.35  and submitted to the appropriate filing officer during the seven 
  4.36  days following the state primary.  For the purposes of this 
  5.1   subdivision, "state officers" mean the governor, lieutenant 
  5.2   governor, secretary of state, state auditor, state treasurer, 
  5.3   and attorney general.  
  5.4      Sec. 7.  Minnesota Statutes 1994, section 204D.12, is 
  5.5   amended to read: 
  5.6      204D.12 [NAMES PLACED ON GENERAL ELECTION BALLOTS.] 
  5.7      Without payment of an additional fee, the county auditor 
  5.8   shall place on the appropriate state general election ballot the 
  5.9   name of every candidate:  
  5.10     (a) Whose nomination at the state primary has been 
  5.11  certified by the appropriate canvassing board; 
  5.12     (b) Who has been nominated by petition, including 
  5.13  candidates certified by the secretary of state; and 
  5.14     (c) Who was nominated and whose name was omitted from the 
  5.15  state nonpartisan primary ballot pursuant to section 204D.07, 
  5.16  subdivision 3.  Only the names of duly nominated candidates may 
  5.17  be placed on a ballot.  
  5.18     A candidate who is nominated for an office by more than one 
  5.19  political party may be listed on the ballot only once. 
  5.20     Sec. 8.  Minnesota Statutes 1994, section 204D.13, is 
  5.21  amended by adding a subdivision to read: 
  5.22     Subd. 4.  [SIMULTANEOUS NOMINATION.] A candidate who is 
  5.23  nominated by a major political party and one or more minor 
  5.24  political parties shall appear on the ballot in the space 
  5.25  designated for the major political party candidate for the 
  5.26  office sought.  A candidate who is nominated by more than one 
  5.27  minor political party but is not the nominee of a major 
  5.28  political party shall appear on the ballot in the position 
  5.29  designated for the first party filing a nominating petition with 
  5.30  the filing officer.  The name of each political party nominating 
  5.31  the candidate shall appear on the ballot with the candidate's 
  5.32  name. 
  5.33     Sec. 9.  [EFFECTIVE DATE.] 
  5.34     This act is effective for the state primary election in 
  5.35  1996. 
  5.36     Sec. 10.  [EXPIRATION.] 
  6.1      Sections 2, 4, and 8 and the amendments to Minnesota 
  6.2   Statutes in sections 1, 3, 5, 6, and 7 expire on June 1, 1997.
