  1.1                          A bill for an act 
  1.2             relating to insurance; regulating trade practices; 
  1.3             prohibiting discrimination based on the credit 
  1.4             worthiness, credit history, credit standing, or credit 
  1.5             capacity of an applicant, policyholder, or enrollee; 
  1.6             amending Minnesota Statutes 1996, section 72A.20, by 
  1.7             adding a subdivision. 
  1.8   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.9      Section 1.  Minnesota Statutes 1996, section 72A.20, is 
  1.10  amended by adding a subdivision to read: 
  1.11     Subd. 36.  [DISCRIMINATION BASED ON CREDIT RATING.] No 
  1.12  insurer as defined in section 72A.201, subdivision 3, or health 
  1.13  plan company as defined in section 62A.011, shall use the credit 
  1.14  worthiness, credit history, credit standing, or credit capacity 
  1.15  of the applicant as an underwriting standard or guideline or 
  1.16  deny coverage to an applicant, policyholder, or enrollee for the 
  1.17  same reason.  
  1.18     Sec. 2.  [EFFECTIVE DATE; APPLICABILITY.] 
  1.19     Section 1 is effective August 1, 1998, and applies to 
  1.20  applications for coverage made on or after that date and to 
  1.21  policies and plans issued or renewed on or after that date to 
  1.22  provide coverage to a Minnesota resident.
