A bill for an act
relating to education; amending requirements for charter school authorizers;
amending Minnesota Statutes 2016, section 124E.05, subdivision 2.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2016, section 124E.05, subdivision 2, is amended to read:


Subd. 2.

Requirements for authorizers.

new text begin (a) An authorizer must, consistent with this
chapter and other applicable law:

new text begin (1) evaluate applications for new and transfer charter schools, and for grade and site
expansions of charter schools;

new text begin (2) deny applications that do not comply with the authorizer's criteria and process;
new text end

new text begin (3) negotiate and execute charter contracts;
new text end

new text begin (4) oversee a charter school's compliance with applicable law and rules, and the charter
contract;
new text end

new text begin (5) monitor and evaluate on an ongoing basis the academic, organizational, and financial
performance of schools it charters, consistent with charter contract terms; and
new text end

new text begin (6) determine whether to renew or terminate a charter contract.

new text begin (b) An authorizer's powers and duties are limited to those provided in this section. The
commissioner must not require an authorizer to perform any function the department exercises
in relation to school districts.
