  1.1                          A bill for an act 
  1.2             relating to state and local government operations; 
  1.3             establishing a metropolitan stadium authority; 
  1.4             providing for the membership and powers of the 
  1.5             authority; proposing coding for new law in Minnesota 
  1.6             Statutes, chapter 473. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  [473.554] [METROPOLITAN STADIUM AUTHORITY.] 
  1.9      Subdivision 1.  [ESTABLISHMENT.] The metropolitan stadium 
  1.10  authority is established, and shall be organized and 
  1.11  administered and have the duties as provided in this section. 
  1.12     Subd. 2.  [MEMBERSHIP.] The authority shall consist of 15 
  1.13  members who are appointed as follows: 
  1.14     (1) one member appointed by the county board of each 
  1.15  metropolitan county; 
  1.16     (2) one member appointed by the governing body of the city 
  1.17  of St. Paul; 
  1.18     (3) one member appointed by the governing body of the city 
  1.19  of Minneapolis; and 
  1.20     (4) six members appointed by the governor, three of whom 
  1.21  must reside within the metropolitan area and three of whom must 
  1.22  reside outside the metropolitan area. 
  1.23     The governor and governing bodies of the cities and 
  1.24  counties must make the appointments under this subdivision by 
  1.25  July 1, 2004. 
  1.26     Subd. 3.  [CHAIR.] The chair shall be appointed by the 
  2.1   governor from among the members appointed under subdivision 2, 
  2.2   clause (4).  The chair shall preside at all meetings of the 
  2.3   authority, if present, and shall perform all other duties and 
  2.4   functions assigned by the authority or by law.  The authority 
  2.5   may appoint from among its members a vice-chair to act for the 
  2.6   chair during temporary absence or disability. 
  2.7      Subd. 4.  [TERMS.] The term of each member and the chair 
  2.8   shall be four years.  The terms shall continue until a successor 
  2.9   is appointed and qualified.  Members may be removed only for 
  2.10  cause. 
  2.11     Subd. 5.  [VACANCIES.] A vacancy shall be filled by the 
  2.12  appointing authority in the same manner in which the original 
  2.13  appointment was made. 
  2.14     Subd. 6.  [COMPENSATION.] Each member of the authority 
  2.15  shall be paid $50 for each day when the member attends one or 
  2.16  more meetings or provides other services, as authorized by the 
  2.17  authority, and shall be reimbursed for all actual and necessary 
  2.18  expenses incurred in the performance of duties. 
  2.19     Subd. 7.  [DUTIES.] (a) The authority shall select a 
  2.20  location for any professional football stadium or baseball park 
  2.21  that is proposed to be constructed in the metropolitan area with 
  2.22  financial assistance from the state or any political subdivision 
  2.23  of the state. 
  2.24     (b) The authority must negotiate with the municipality 
  2.25  where the stadium or ballpark is proposed to be located and the 
  2.26  owner of the professional sports team that will play in the 
  2.27  facility.  It must review and approve the terms of the plans for 
  2.28  public expenditures and other financing of the construction and 
  2.29  operation of the facilities, as well as leases and use 
  2.30  agreements relating to the facilities. 
  2.31     [EFFECTIVE DATE.] This section is effective the day 
  2.32  following final enactment.
