A bill for an act
relating to higher education; modifying certain concurrent enrollment provisions;
requiring the Board of Trustees of the Minnesota State Colleges and Universities
to establish a supplemental instruction program; amending Minnesota Statutes
2014, section 124D.09, subdivision 10; proposing coding for new law in
Minnesota Statutes, chapter 136F.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

Minnesota Statutes 2014, section 124D.09, subdivision 10, is amended to
read:

Subd. 10.

Courses according to agreements.

subdivision 5, may enroll in a new text begin developmental course under paragraph (b) or new text end nonsectarian
course taught by a secondary teacher or a postsecondary faculty member and offered at
a secondary school, or another location, according to an agreement between a public
school board and the governing body of an eligible public postsecondary system or an
eligible private postsecondary institution, as defined in subdivision 3. All provisions of
this section shall apply to a pupil, public school board, district, and the governing body of
a postsecondary institution, except as otherwise provided.

new text begin (b) Notwithstanding subdivision 9, paragraph (b), a public school board and
the governing body of an eligible public postsecondary system may agree to offer
developmental courses under this subdivision. Notwithstanding subdivision 12, no
postsecondary credit may be granted for a developmental course taken under this
subdivision. A developmental course must:

new text begin (1) be in the subject area of writing, reading, or mathematics; and

new text begin (2) include in the curriculum:

new text begin (i) relevant high school academic standards under section 120B.021; and
new text end

new text begin (ii) the minimum course placement standards for a credit-bearing course as defined
in section 136F.38.

Sec. 2.

new text begin (a) For purposes of this section, the following terms
have the meanings given.

new text begin (b) "Credit-bearing course" means a college entry-level course that meets the
requirements for a diploma, certificate, or degree.

new text begin (c) "Developmental noncredit course" means a course that carries college credit for
financial aid purposes, but does not meet the requirements for a diploma, certificate,
or degree.

new text begin (d) "Targeted support" means academic support, including but not limited to
tutoring and directed group study time, related to increasing a student's understanding of
a credit-bearing course.

new text begin Supplemental instruction program. new text end

new text begin (a) The board shall establish at each
campus a supplemental instruction program. The program must minimize the placement
of students in developmental noncredit courses by providing a supplemental instruction
course structure that results in earning the equivalent of credit in a credit-bearing course
while providing targeted support to a student who:

new text begin (1) did not meet the minimum course placement criteria for a credit-bearing course;
and
new text end

new text begin (2) using multiple measures of assessment, is identified as likely to succeed in a
credit-bearing course if targeted support is provided.

new text begin (b) A supplemental instruction course must include a credit-bearing course or be
designated by the college or university as equivalent to a specific credit-bearing course.

new text begin (c) The board must provide individual counseling to any student who does not
receive a passing grade in a supplemental instruction course. The individual counseling
must include career and employment advice and guidance, and information on educational
opportunities available to the student.

new text begin The board shall establish a fee to be charged to each student
participating in a supplemental instruction course. The fee shall not exceed 50 percent of
the average cost of one course credit for an undergraduate degree program course offered
at a state college or university.

new text begin Developmental courses. new text end

new text begin If a student does not meet the criteria for
inclusion in a supplemental instruction course, the board may require the student to
participate, at no cost to the student, in adult basic education or a developmental noncredit
course designed as a prerequisite for either a supplemental instruction course under
subdivision 2 or a credit-bearing course. The board shall not require a student who has
taken a developmental course under section 124D.09, subdivision 10, to participate in
adult basic education or a developmental noncredit course in the same subject area. The
board shall not require a student to participate in adult basic education or developmental
noncredit courses for a period longer than one quarter or one semester.

new text begin (a) The board must annually report by February 1 to the chairs and
ranking minority members of the legislative committees with primary jurisdiction over
higher education policy with the following information from the previous academic year
for each system campus:

new text begin (1) the number of students participating in the supplemental instruction program;
new text end

new text begin (2) the number of students that received credit in a supplemental instruction course;
new text end

new text begin (3) the graduation rate of students enrolling in a supplemental instruction course, if
available;
new text end

new text begin (4) the graduation rate of students not enrolling in a supplemental instruction course;
new text end

new text begin (5) the amount of time, on average, that it takes a student enrolling in a supplemental
instruction course to graduate, if available;

new text begin (6) the amount of time, on average, that it takes a student not enrolling in a
supplemental instruction course to graduate; and
new text end

new text begin (7) the date of graduation and the name and location of the secondary school,
including the charter school from which the student graduated, or whether the student
received a general education diploma or was homeschooled.

new text begin (b) The board shall provide, for each reporting requirement under paragraph (a),
clauses (1) to (7), a breakdown of the student data by race and ethnicity.

new text begin EFFECTIVE DATE. new text end

new text begin This section is effective the day following final enactment.
The Board of Trustees of the Minnesota State Colleges and Universities must begin
offering a supplemental instruction program at each Minnesota State College and
University campus by the beginning of the 2018-2019 academic year.
