  1.1                          A bill for an act 
  1.2             relating to human rights; including status with regard 
  1.3             to adoption in the definition of familial status; 
  1.4             prohibiting discrimination based on status with regard 
  1.5             to adoption by employers; modifying the definition of 
  1.6             familial status; amending Minnesota Statutes 2003 
  1.7             Supplement, sections 363A.03, subdivision 18, by 
  1.8             adding a subdivision; 363A.08, subdivision 2. 
  1.9   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.10     Section 1.  Minnesota Statutes 2003 Supplement, section 
  1.11  363A.03, subdivision 18, is amended to read: 
  1.12     Subd. 18.  [FAMILIAL STATUS.] "Familial status" means the 
  1.13  condition of one or more minors being domiciled with (a) their 
  1.14  parent or parents or the minor's legal guardian or (b) the 
  1.15  designee of the parent or parents or guardian with the written 
  1.16  permission of the parent or parents or guardian.  The 
  1.17  protections afforded against discrimination on the basis of 
  1.18  family familial status apply to any person who is pregnant or is 
  1.19  in the process of legally adopting a minor child or securing 
  1.20  legal custody of an individual who has not attained the age of 
  1.21  majority.  
  1.22     Sec. 2.  Minnesota Statutes 2003 Supplement, section 
  1.23  363A.03, is amended by adding a subdivision to read: 
  1.24     Subd. 46a.  [STATUS WITH REGARD TO ADOPTION.] "Status with 
  1.25  regard to adoption" means the condition of being in the process 
  1.26  of legally adopting a minor child. 
  1.27     Sec. 3.  Minnesota Statutes 2003 Supplement, section 
  2.1   363A.08, subdivision 2, is amended to read: 
  2.2      Subd. 2.  [EMPLOYER.] Except when based on a bona fide 
  2.3   occupational qualification, it is an unfair employment practice 
  2.4   for an employer, because of race, color, creed, religion, 
  2.5   national origin, sex, marital status, status with regard to 
  2.6   adoption, status with regard to public assistance, membership or 
  2.7   activity in a local commission, disability, sexual orientation, 
  2.8   or age to: 
  2.9      (a) refuse to hire or to maintain a system of employment 
  2.10  which unreasonably excludes a person seeking employment; or 
  2.11     (b) discharge an employee; or 
  2.12     (c) discriminate against a person with respect to hiring, 
  2.13  tenure, compensation, terms, upgrading, conditions, facilities, 
  2.14  or privileges of employment.
