A bill for an act
relating to consumer protection; requiring removal of structures built with
pressure-treated lumber containing chromated copper arsenate from schools,
parks, and child care facilities; proposing coding for new law in Minnesota
Statutes, chapter 325F.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1.

new text begin For purposes of this section:

new text begin (1) "school" means a public school, as defined under section 120A.05, subdivisions
9, 11, 13, and 17, or a nonpublic school, church, or religious organization in which a child
is provided instruction in compliance with sections 120A.22 and 120A.24 or section
124D.10;

new text begin (2) "park" means any park or playground maintained by the state or a city, town,
or county; and

new text begin (3) "child care facility" has the meaning given under section 121A.15, subdivision 9.

new text begin By August 1, 2009, all structures constructed of
pressure-treated lumber containing chromated copper arsenate must be removed from the
property of a school, park, or child care facility.

new text begin After August 1, 2009, a structure constructed of
pressure-treated lumber containing chromated copper arsenate located on the property of a
school, park, or child care facility is a public nuisance and must be removed according to
sections 463.15 to 463.26.
