  1.1                          A bill for an act 
  1.2             relating to health; authorizing filling certain 
  1.3             prescriptions written by physicians, osteopaths, 
  1.4             podiatrists, dentists, or veterinarians licensed in 
  1.5             another United States jurisdiction; amending Minnesota 
  1.6             Statutes 1994, section 152.11, by adding subdivisions. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 152.11, is 
  1.9   amended by adding a subdivision to read: 
  1.10     Subd. 4.  Notwithstanding subdivisions 1 and 2, a person 
  1.11  may dispense a controlled substance included in schedule II, 
  1.12  III, or IV of section 152.02 with a prescription written by a 
  1.13  doctor of medicine, a doctor of osteopathy licensed to practice 
  1.14  medicine, a doctor of dental surgery, a doctor of dental 
  1.15  medicine, a doctor of podiatry, or a doctor of veterinary 
  1.16  medicine lawfully licensed to prescribe in any state or 
  1.17  jurisdiction of the United States if the prescription is being 
  1.18  billed: 
  1.19     (1) by a mail-order pharmacy located in Minnesota; or 
  1.20     (2) for a person who is physically present in Minnesota at 
  1.21  the time the prescription is filled but is not a resident of 
  1.22  Minnesota. 
  1.23     Sec. 2.  Minnesota Statutes 1994, section 152.11, is 
  1.24  amended by adding a subdivision to read: 
  1.25     Subd. 5.  Nothing in this section may be construed to 
  1.26  authorize a person licensed in a state or jurisdiction outside 
  2.1   Minnesota to prescribe a controlled substance with intent to 
  2.2   assist another in taking the other's own life in violation of 
  2.3   section 609.215 with intent or knowledge that the prescription 
  2.4   will be dispensed in Minnesota, regardless of whether the 
  2.5   prescription would be unlawful in the state in which the person 
  2.6   is licensed.
