  1.1                          A bill for an act 
  1.2             relating to animals; changing liability for certain 
  1.3             animals running at large; amending Minnesota Statutes 
  1.4             2002, section 346.16. 
  1.5   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.6      Section 1.  Minnesota Statutes 2002, section 346.16, is 
  1.7   amended to read: 
  1.8      346.16 [RUNNING AT LARGE; DEFINED; STRICT LIABILITY; 
  1.9   PROHIBITED; TREBLE DAMAGES.] 
  1.10     (a) The herding of any animal of the species of cattle, 
  1.11  horse, ass, mule, sheep, swine, or goat upon any land over the 
  1.12  protest and against the will of the owner shall be deemed a 
  1.13  running at large.  
  1.14     (b) Any owner or any person having control of any such 
  1.15  animal shall be strictly liable to the person aggrieved for the 
  1.16  actual damages sustained by the aggrieved person in a civil 
  1.17  action brought for that purpose if any such domestic animal runs 
  1.18  at large. 
  1.19     (c) It shall be unlawful for any owner or any person having 
  1.20  the control of any such animal to permit the same to run at 
  1.21  large in the state.  
  1.22     (d) Any person who shall knowingly permit the running at 
  1.23  large of any such domestic animal shall be liable to the person 
  1.24  aggrieved for treble damages sustained by the aggrieved person, 
  1.25  to be recovered in a civil action brought for that purpose.
