  1.1                          A bill for an act
  1.2             relating to consumer protection; requiring that items 
  1.3             be provided free of charge in the event of price 
  1.4             scanner errors; proposing coding for new law in 
  1.5             Minnesota Statutes, chapter 325F. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  [325F.556] [SCANNER ERRORS.] 
  1.8      Subdivision 1.  [PROVIDING ITEM FREE OF CHARGE.] If, in any 
  1.9   store selling retail merchandise and using an electronic or 
  1.10  magnetic scanner to read the prices of items, a scanner 
  1.11  indicates a price for an item that is greater than the item's 
  1.12  marked price, the retailer must give the item to the customer 
  1.13  without charge.  For the purposes of this section, "marked 
  1.14  price" means any price displayed on or near an item in a manner 
  1.15  suggesting to the customer that the price displayed is the price 
  1.16  of the item. 
  1.17     Subd. 2.  [EXCEPTIONS.] (a) If the marked price of an item 
  1.18  that is the subject of a scanner error pursuant to subdivision 1 
  1.19  is greater than $10, then the retailer may charge the customer 
  1.20  the difference between the marked price and $10 for the item. 
  1.21     (b) If the customer purchases two or more of an item that 
  1.22  is the subject of a scanner error pursuant to subdivision 1, 
  1.23  then the retailer is required to provide only one of that item 
  1.24  without charge.
