A bill for an act
 relating to education finance; authorizing Independent School District No. 577,
Willow River, to recertify its school levy for taxes payable in 2006.

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

Section 1. new text begin RECERTIFICATION OF 2006 SCHOOL DISTRICT LEVY.

new text begin Subdivision 1. new text end

new text begin Eligibility. new text end

new text begin Independent School District No. 577, Willow River, may
recertify its 2005 levy for taxes payable in 2006 if:

new text begin (1) the district is in statutory operating debt according to Minnesota Statutes, section
123B.81; and
 new text end

new text begin (2) the district conducts a successful referendum at the March 2006 election.

new text begin Recertification process. new text end

new text begin Notwithstanding any law to the contrary,
Independent School District No. 577, Willow River, may recertify its 2005 levy for taxes
payable in 2006 in the following manner:

new text begin (1) within five days after the effective date of this section, the board must notify the
Department of Education that it has successfully passed its referendum;
new text end

new text begin (2) within five days after receiving the notice from the district, the Department of
Education must recompute the district's 2005 payable in 2006 levy limitation and report
these amounts to the school district and the county auditor; and

new text begin (3) within five days after receiving the notice from the Department of Education,
the school district must certify the added levy amount to the county auditor. The county
auditor must add these amounts to the 2005 levy for taxes payable in 2006 previously
certified by the school district.

new text begin This section is effective the day following final enactment
and applies for taxes payable in 2006.
