1.1 A bill for an act 1.2 relating to workers' compensation; transferring the 1.3 excess surplus in the workers' compensation assigned 1.4 risk plan to the state dislocated worker program. 1.5 BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 1.6 Section 1. [MINNESOTA WORKERS' COMPENSATION ASSIGNED RISK 1.7 PLAN SURPLUS TRANSFER.] 1.8 Subdivision 1. [EXCESS SURPLUS.] "Excess surplus" means 1.9 the amount of the Minnesota workers' compensation assigned risk 1.10 plan funds that exceeds the amount necessary to pay all current 1.11 liabilities of this plan, including, but not limited to: 1.12 (1) administrative expenses; 1.13 (2) benefit claims; and 1.14 (3) in the event the Minnesota workers' compensation 1.15 assigned risk plan is dissolved under Minnesota Statutes, 1.16 section 79.251, subdivision 8, the amounts which would be due 1.17 insurers who have paid assessments to this plan. 1.18 Subd. 2. [TRANSFER OF EXCESS SURPLUS FUNDS.] (a) On or 1.19 before July 15, 2002, the commissioner of commerce shall certify 1.20 to the commissioner of finance the amount of the Minnesota 1.21 workers' compensation assigned risk plan excess surplus. On or 1.22 before July 15, 2002, the commissioner of finance and the 1.23 commissioner of commerce must direct the transfer of $94,900,000 1.24 of assets of the assigned risk plan excess surplus to the 1.25 Minnesota job skills partnership board for the state dislocated 2.1 worker program under Minnesota Statutes, section 116L.17. 2.2 (b) The transfer of funds authorized by this subdivision is 2.3 not subject to review under Minnesota Statutes, chapter 14. 2.4 Sec. 2. [EFFECTIVE DATE.] 2.5 Section 1 is effective the day following final enactment.
