A bill for an act
relating to health; prohibiting the use of incentives or disincentives for using certain
pharmacies; amending Minnesota Statutes 2016, section 151.71, by adding a
subdivision.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:
Minnesota Statutes 2016, section 151.71, is amended by adding a subdivision
to read:

(a) A health plan company or pharmacy
benefit manager is prohibited from requiring or providing financial incentives to an individual
to use a retail pharmacy, mail order pharmacy, specialty pharmacy, or other entity providing
pharmacy services in which a pharmacy benefit manager has an ownership interest or that
has an ownership interest in a pharmacy benefit manager.

(b) A health plan company or pharmacy benefit manager is prohibited from imposing
limits, including quantity limits or refill frequency limits, on a patient's access to medication
that differ based on whether the health plan company or pharmacy benefit manager has an
ownership interest in a pharmacy.
