A bill for an act
relating to highway traffic regulations; prohibiting issuance of citations based
solely on photographic evidence; providing exceptions; proposing coding for
new law in Minnesota Statutes, chapter 169.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA:

A city or county law
enforcement agency may not issue a citation for any misdemeanor or petty misdemeanor
violation of any provision of this chapter or local ordinance in conformity therewith based
solely on photographic evidence that purports to depict the violation and identify the
vehicle used in the violation. For purposes of this subdivision, "photographic evidence"
does not include evidence obtained from a speed-measuring device operated in conformity
with section 169.14, subdivision 10.

(a) Subdivision 1 does not prohibit or limit the issuance of
citations for a violation committed:

(1) at a rail-highway grade crossing; or
new text end
new text begin
(2) in a school zone as defined in section 169.14, subdivision 5b.

(b) Subdivision 1 does not prohibit a peace officer from issuing a citation for a
violation witnessed by the peace officer at the time of commission.

Section 1 is effective the day following final enactment.
