  1.1                          A bill for an act
  1.2             relating to crime; providing mandatory minimum prison 
  1.3             sentences for persons convicted of first or second 
  1.4             degree forcible or violent criminal sexual conduct; 
  1.5             amending Minnesota Statutes 1994, sections 609.342, 
  1.6             subdivision 2; and 609.343, subdivision 2. 
  1.7   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.8      Section 1.  Minnesota Statutes 1994, section 609.342, 
  1.9   subdivision 2, is amended to read: 
  1.10     Subd. 2.  [PENALTY.] Except as otherwise provided in 
  1.11  section 609.346, subdivision 2a or 2b, a person convicted under 
  1.12  subdivision 1, clause (a), (b), or (g), may be sentenced to 
  1.13  imprisonment for not more than 30 years or to a payment of a 
  1.14  fine of not more than $40,000, or both.  Notwithstanding section 
  1.15  243.05, 244.04, 609.11, 609.135, or 609.346, a person convicted 
  1.16  under subdivision 1, clause (c), (d), (e), (f), or (h), shall be 
  1.17  committed to the commissioner of corrections for a term of 
  1.18  imprisonment of at least 20 years but not more than 30 years, 
  1.19  and may be sentenced to payment of a fine of not more than 
  1.20  $40,000. 
  1.21     Sec. 2.  Minnesota Statutes 1994, section 609.343, 
  1.22  subdivision 2, is amended to read: 
  1.23     Subd. 2.  [PENALTY.] Except as otherwise provided in 
  1.24  section 609.346, subdivision 2a or 2b, a person convicted under 
  1.25  subdivision 1, clause (a), (b), or (g), may be sentenced to 
  1.26  imprisonment for not more than 25 years or to a payment of a 
  2.1   fine of not more than $35,000, or both.  Notwithstanding section 
  2.2   243.05, 244.04, 609.11, 609.135, or 609.346, a person convicted 
  2.3   under subdivision 1, clause (c), (d), (e), (f), or (h), shall be 
  2.4   committed to the commissioner of corrections for a term of 
  2.5   imprisonment of at least 15 years but not more than 25 years, 
  2.6   and may be sentenced to payment of a fine of not more than 
  2.7   $35,000. 
  2.8      Sec. 3.  [EFFECTIVE DATE.] 
  2.9      Sections 1 and 2 are effective August 1, 1996, and apply to 
  2.10  crimes committed on or after that date.
