  1.1                          A bill for an act
  1.2             relating to highways; mandating certain charges by 
  1.3             road authorities for removing nonconforming mailbox 
  1.4             installations and supports; amending Minnesota 
  1.5             Statutes 1994, section 169.072, subdivision 3. 
  1.6   BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF MINNESOTA: 
  1.7      Section 1.  Minnesota Statutes 1994, section 169.072, 
  1.8   subdivision 3, is amended to read: 
  1.9      Subd. 3.  [REMOVAL, NOTICE.] (a) After adoption of the 
  1.10  rules authorized under subdivision 2, the commissioner or a road 
  1.11  authority as defined in section 160.02, subdivision 9, may 
  1.12  remove and replace a mailbox installation or support that is (1) 
  1.13  located on a street or highway under the jurisdiction of the 
  1.14  commissioner or road authority, and (2) does not conform to the 
  1.15  rules adopted under subdivision 2.  The commissioner or road 
  1.16  authority may remove and replace a nonconforming mailbox 
  1.17  installation or support not less than 60 days after giving 
  1.18  notice, by personal notice or certified mail to the owner or the 
  1.19  resident at the address served by the mailbox, of its intent to 
  1.20  remove and replace the installation or support.  The 
  1.21  commissioner or road authority may shall charge the owner or 
  1.22  resident not more than $75 for the cost of the removal and 
  1.23  replacement.  
  1.24     (b) The notice must at a minimum: 
  1.25     (1) inform the owner of the nonconforming installation or 
  2.1   support; 
  2.2      (2) inform the owner or resident of the applicable law and 
  2.3   rules, including the rules that contain the standards for 
  2.4   mailbox installations and supports on public streets and 
  2.5   highways; 
  2.6      (3) inform the owner or resident that the owner or resident 
  2.7   must remove the installation or support or bring it into 
  2.8   compliance with the rules within 60 days of the date of the 
  2.9   notice; 
  2.10     (4) inform the owner or resident of the applicable laws and 
  2.11  rules and the standards for mailbox installations and supports 
  2.12  on public streets and highways, and provide plans or diagrams of 
  2.13  examples of conforming installations or supports; 
  2.14     (5) inform the owner or resident that if the nonconforming 
  2.15  installation or support is not removed or replaced within 60 
  2.16  days of the date of the notice, the commissioner or road 
  2.17  authority may remove and replace the installation or support at 
  2.18  a cost of up to $75 to the owner or resident; and 
  2.19     (6) inform the owner or resident that where the replacement 
  2.20  is made in conjunction with certain federally aided highway 
  2.21  construction projects the replacement may be made at partial or 
  2.22  no cost to the owner or resident.
